Case #8: <br /> <br />Request to Rezone Property from B-1 Business and R-1 Single Family <br />Residential to Planned Unit Development; Case of Royal Oaks Realty, Inc. <br /> <br />Case #9: <br /> <br />Request for Preliminary Plat (PUD Site Plan) of The Ponds; Case of Royal <br />Oaks Realty <br /> <br />Case #10: <br /> <br />Request for Site Plan Review for Townhomes Located within The Ponds <br />Subdivision; Case of Royal Oaks Realty, Inc. <br /> <br />Case #11: <br /> <br />Request to Appeal Board of Adjustments Decision to Deny a Variance to <br />Height Restrictions for a Senior Apartment Building; Case of Royal Oaks <br />Realty, Inc. <br /> <br />Case #12: <br /> <br />Request for Site Plan Review for an Apartment Building Located within The <br />Ponds Subdivision; Case of Royal Oaks Realty, Inc. <br /> <br />Principal Planner Tmdgeon stated that Royal Oaks Realty has submitted an application to rezone <br />property located at the southwest comer of CSAH 5 (Nowthen Boulevard) and Dysprosium <br />Street from B-1 Business and R-1 Single Family Residential to Planned Unit Development <br />(P.U.D.). The rezoning would allow the property to be subdivided for 73 single-family lots, 152 <br />townhome units and 82 apartment units. The property is 86.71 acres in size and is within the <br />Metropolitan Urban Service Area (MUSA). The preliminary plat accompanying the application <br />proposes to develop 73 single family homes on the western part of the property, 152 townhomes <br />along Nowthen Boulevard., and an 82 unit apartment building for senior citizens along <br />Dysprosium St. The current Comprehensive Plan identifies this area for commercial and single <br />family development. The March 2001 Draft Comprehensive Plan shows this area as being High <br />Density Residential along Dysprosium Street, Medium Density Residential along Nowthen <br />Boulevard and Low Density Residential on the western part of the property. The development <br />property is adjacent to property that is zoned R-1 Single Family Residential, with the exception <br />of a parcel north of the development property that is zoned R-3 Urban Residential, and a portion <br />of the Flintwood Hills P.U.D. that is adjacent to the southeast portion of the development <br />property. The Lord of Life Church property lying on the northeast side of Nowthen Boulevard <br />is zoned B-l, Business and the Savannah Oaks Senior Apartment Building on the eastern side of <br />Dysprosium is zoned MR Multi-Family Residential. A minor Comprehensive Plan amendment <br />may be required if the March 2001 Draft Comprehensive Plan is not adopted by City Council by <br />the time their proposal has completed all necessary reviews. The landscape plan meets the 20% <br />open space requirement for a Planned Unit Development. City staff has reviewed the <br />landscaping plan as part of the site plan review process. The initial landscaping plan was <br />deficient. The developer is working on a new landscaping plan to meet the City standards. The <br />Planning Commission held a public hearing in regards to the proposed rezoning on June 5, 2001. <br />After review of the application, the Planning Commission recommended that the rezoning <br />application submitted by Royal Oaks Realty be approved by the City Council. City Staff and the <br />Planning Commission recommended approval of the request for rezoning of the property from B- <br />I Business and R-1 Single Family Residential to Planned Unit Development. <br /> <br />City Council/June 26, 2001 <br />Page 13 of 28 <br /> <br /> <br />
