Community Development Director Frolik replied that the City is requiring that a 13 foot <br />screening wall be installed, which she felt was a step in the right direction and then staff will <br />continue discussions in regards to an all enclosed facility. <br /> <br />Councilmember Hendriksen inquired if there were still operations going on in the northerly <br />parcels. <br /> <br />Community Development Director Frolik replied that currently there is storage on the site. <br /> <br />Councilmember Hendriksen inquired if the conditional use permit allows for operations on the <br />northerly parcels. <br /> <br />Community Development Director Frolik replied that the Conditional Use Permit will allow for <br />outside storage of landscape timbers, and containers that hold materials for transport on Lot 2. <br /> <br />Councilmember Hendriksen inquired as to where staff was at with negotiations for an all <br />enclosed facility. <br /> <br />City Administrator Norman replied that staff is in negotiations with the property owners to the <br />east, but it is a complicated project and will take a few months to put together. <br /> <br />Councilmember Hendriksen inquired as to what the incentive was to granting the conditional use <br />permit at this time instead of waiting for staff to complete their negotiations. <br /> <br />Mr. Karst, St. Paul Terminals, explained that in order for them to generate the necessary revenues <br />they cannot have the facility shut down for the next several months while negotiations are taking <br />place. He noted that it would cost them $30,000 a month. <br /> <br />Councilmember Zimmerman stated that he felt that St. Paul Terminals would be an improvement <br />to the area. <br /> <br />Mayor Gamec stated that he would much rather have St. Paul Terminals clean the site and work <br />with the City rather than having the City clean the site. <br /> <br />Mr. Karst questioned item #21 of the Conditional Use Permit requiring an escrow for the <br />screening improvements. He explained that he has already borrowed money to install the fence <br />and he does not have the ability to get the letter of credit for the escrow. He already has the <br />materials to install the fence and anticipates it being done in the spring. <br /> <br />City Attorney Goodrich inquired as to how Mr. Karst could guarantee to the City that the fence <br />would be constructed. <br /> <br />Mr. Karst inquired as to why both #20 and #21 are included in the Conditional Use Permit, <br />because if he does not comply with the terms then he would lose the permit. <br /> <br />City Council/June 26, 2001 <br />Page 21 of 28 <br /> <br /> <br />
