City Attorney Goodrich replied that it has been the City's experience that if they don't have the <br />escrow and they try and revoke the permit it will take several months to do so and the Courts <br />may not require the fence be installed. <br /> <br />Mr. Karst expressed concern with the amount that is being requested to be escrowed because the <br />fence will not cost $73,000. <br /> <br />City Attorney Goodrich replied that the amount can be negotiated. He recommended reducing <br />the amount to $50,000. <br /> <br />Councilmember Anderson inquired if it made more sense to revoke the Conditional Use Permit <br />that currently exists on the property prior to issuing a new permit. <br /> <br />City Attorney Goodrich replied that in most situations it would make sense to revoke the existing <br />Conditional Use Permit first, but St. Paul Terminals has very complex reasons for the process to <br />be handled this way and that is why #41 was added to the terms of the Conditional Use Permit. <br /> <br />Councilmember Hendriksen inquired as to when Mr. Karst anticipated the screening wall being <br />completed. <br /> <br />Mr. Karst replied that once the engineer completes the plans he will start the wall and anticipates <br />completion by the spring or by June 2002. <br /> <br />Gary Hanson, Bake Star, Inc., stated that his business is adjacent to the property. He stated that <br />he has heard rumors that the piece of property between the two businesses is being acquired for <br />the business. If that is the case, he will have many of the same concerns as he did with the Ace <br />Solid Waste Transfer station. He stated that the Council needs to make sure that the property <br />complies with the permit and that nothing be stipulated that does not conform to light industrial <br />property. Presently there is a detour sending Sauter truck traffic onto Azurite Street and <br />McKinley Street. He wanted to make sure that that truck traffic was temporary and if any <br />damage is done to the street that would require repair he does not think that he should have pay <br />for that. <br /> <br />City Attorney Goodrich recommended that the Conditional Use Permit be amended to require the <br />screening be completed by July 1, 2003, and the amount escrowed be set at $50,000. <br /> <br />Mayor Gamec suggested extending the completion date for the screening to September 30, 2002. <br /> <br />Consensus of the Council was to require the screening to be completed by September 30, 2002. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Anderson, to adopt Resolution <br />#01-06-240 adopting Findings of Fact #0562 relating to St. Paul Terminals request for a <br /> <br />City Council/June 26, 2001 <br />Page 22 of 28 <br /> <br /> <br />
