City Administrator Norman replied that the Council is the entity that makes the decision and the <br />City would only be delaying the process if they don't move forward. He explained that the <br />consultant will be reviewing the same issues as the EAW. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Anderson, to enter into the <br />agreement with ProSource Technologies, dated June 21, 2001, for the specific purpose of <br />providing an environmental review of The Ponds project subject to City Attorney review and <br />subject to the confirmation that the Developer will cover the cost. <br /> <br />Motion carried. <br />and Zimmerman. <br /> <br />Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, Hendriksen, <br />Voting No: None. <br /> <br />Councilmember Kurak inquired if the review is completed could it be used on a future <br />development proposal. <br /> <br />City Attorney Goodrich replied that the data that is generated should be usable, but it may have <br />to be updated. ~:' ' " <br /> <br />Case #7: Liquor License <br /> <br />City Attorney Goodrich stated that under State law the City is unlimited as to the number off-sale <br />licenses they can issue, but the City can limit that number. <br /> <br />Councilmember Anderson stated that there seems to be more of a concern over an on-sale liquor <br />licenses than off-sale liquor licenses. <br /> <br />Police Chief Gustafson replied that from the Police standpoint there are a lot more oCcUrrences at <br />an on-site liquor establishment. <br /> <br />Councilmember Anderson inquired if other cities limit on-sale liquor licenses. <br /> <br />Mayor Gamec replied that the City probably would not deny any large restaurants from coming <br />into the City. ~ <br /> <br />Councilmember Anderson inquired if on-sale liCenSes are transferable,." <br /> <br />Police Chief Gustafson replied that the new owner must apply for a new license. An owner <br />cannot convey a new license, the City must do that. The reason for that is that the law requires a <br />background check on the applicant. <br /> <br />Councilmember Hendriksen inquired as to the urgency of the case. <br /> <br />Councilmember Kurak replied that the moratorium had expired. <br /> <br />City Council/July 10, 2001 <br />Page 12 of 14 <br /> <br /> <br />
