Councilmember Zimmerman stated that if Mr. Niles does not want the land zoned medium
density then maybe the Council should not change anything unless a request is received.

Councilmember Anderson replied that something has to be done with the property, because many
complaints are received about the business.

Consensus of the Council was to designate the land west of T.H. #47 as medium density on the
land use map that will be submitted for a public hearing on January 24, 2002.

Mr. Ebe inquired if since the high density request was denied could the Council go ahead and
agree with changing the land use to medium density.

Principal Planner Tmdgeon replied that the Council would prefer to see a medium density plan
prior to making any formal decision.

Mayor Gamec stated that a public hearing will be held to change the land use to medium density
at the January 24, 2001 meeting.

Miles Borstad, representing Mr. Niles on the west side of T.H. #47, recommended that there be
some neighborhood commercial at the comer of the east side parcel with the remaining parcel
being designated as medium density.

City Administrator Norman recommended that Mr. Borstad work with staff on a plan for the east
side of T.H. #47.

Councilmember Hendriksen requested that the aerial photographs be kept in the building for
reference purposes. He stated that earlier in the evening the Council had considered 13 changes
to a future draft of the Comprehensive Plan land use map during a work session and two of the
changes concerned the Kurak property and Councilmember Kurak made the siding vote. He
inquired if Ms. Kurak should be able to vote on an issue dealing with her own property.

City Attorney Goodrich replied that he would review the issue and get back to the Council.

Councilmember Hendriksen stated that Councilmember Kurak's vote was a determining factor
for what would be placed on the land use map and so he requested that the City Attorney report
back to staff prior to the land use map being presented for a public hearing.

Consensus of the Council was for staff to bring forward the property owners recommendation for
the east side of T.H. #47.

E. Orrin Thompson

Item was tabled.

City Council/December 11, 2001
