F. Lord of Life

Item was tabled.

Mayor Gamec recessed the regular meeting of the City Council at 8:52 p.m.

Mayor Gamec called the regular meeting of the City Council back to order at 8:59 p.m.

Councilmember Hendriksen stated that he questions what the appropriate way is to handle the
proposed land use changes. He would recommend that the changes not be made to the land use
map prior to the public hearing, but have the changes be presented to the Council during the
public hearing and then a decision can be made. He did not think that it should be assumed that
the changes requested will be acceptable. Staff stated that they were going to take what the
property owner wanted on the east side of T.H. #47 and add it to the plan and then discuss it at a
public hearing, but he felt that the property owner should make the request and be subject to the
public hearing.

City Administrator Norman stated that he thought the direction that was given is that the property
on the west side of T.H. #47 would be designated as medium density and the property on the east
side would be designated medium density and commercial.

Councilmember Hendriksen stated that he did not think that they should place something on the
land use map that the Council has not reviewed. He recommended leaving the land use as is and
then at the public hearing the Council can accept the property owner's input and react to it.

City Administrator Norman felt it would be more appropriate to make the change on the map that
would be going out to the public so that they would be informed of the possible changes.

Councilmember Anderson stated that since there is considerable dissatisfaction with the current
use on the property, it would make sense to have staff work with the property owner on the issue.

City Attorney Goodrich stated that the Council should be deciding how they want the land to be
designated and then hold a public hearing on it, rather than the property owner deciding and then
simply the City placing the change on the map. He was concerned that if they allow the property
owner to make the decision they will be setting precedent.

Councilmember Hendriksen stated that he would agree that it is good to have the change
published. If the Council can make a decision on what they want to see on the property and
include it on the map he would agree with that.

City Administrator Norman suggested that the comer at 153ra Avenue and T.H. #47 be
commercial with the remainder of the property being medium density.

City Council/December 11, 2001
