#8: will <br />#9: will <br />#10 will not <br />#1 ! will not <br /> <br />City Attorney Goodrich stated that if the Council is inclined to deny the high-density request, but <br />permit a medium density, will they be able to say then that the proposed use will not <br />substantially impair. <br /> <br />Councilmember Anderson replied yes, because of the density. <br /> <br />City Attorney Goodrich noted that the Council will be facing the same findings to approve a <br />medium density. <br /> <br />Motion by Councilmem/~ea~r Hendriksen, seconded by Councilmember Zimmerman, to adopt <br />Resolution #01-12-4~ adopting Findings of Fact #0587 relating to a request to rezone the <br />subject property from R-IR Residential, B-1 Business, and B-2 Business to MR, Multiple <br />Residential. <br /> <br />Motion carried. Voting Yes: Councilmembers Hendriksen, Zimmerman, Anderson, and Kurak. <br />Voting No: Mayor Gamec. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Hendriksen, to adopt <br />Resolution #01-12-¢g~g' denying the request to rezone, based upon the Findings, the subject <br />property from R-IR Residential, B-1 Business, and B-2 Business to MR, Multiple Residential, <br />based on the findings of facts. <br /> <br />Motion carried. Voting Yes: Councilmembers Zimmerman, Hendriksen, Anderson, and Kurak. <br />Voting No: Mayor Gamec. <br /> <br />Case #4: <br /> <br />Request to Rezone Certain Property from R-1 Rural Residential to R-1 <br />Urban Residential; Case of Oakwood Land Development, Inc. <br /> <br />Principal Planner Trudgeon stated that on behalf of Jacob and Therese Barthold and Lee <br />Kappedahl, Oakwood Land Development is requesting a rezoning of property in Section 14 from <br />R-1 Rural Residential to R-1 Urban Residential to permit development of the subject property <br />with single family residential lots served by sanitary sewer and municipal water. The property is <br />approximately 9.7 acres in size. At Mr. Barthold's request, the subject property was part of a <br />Comprehensive Plan amendment initiated in 1993 by the City of Ramsey for a MUSA boundary <br />expansion. By the time the amendment was approved by Metropolitan Council in 1995, a <br />portion of Mr. Barthold's property, which is the subject of today's request, was not included in <br />the official MUSA boundary expansion exhibit. The fact that this portion of Mr. Barthold's <br />property is not in the MUSA came to light during the preliminary plat review of Apple Ridge <br /> <br />City Council/December 11, 2001 <br /> Page 16 of 25 <br /> <br /> <br />
