(ensuing phases named River Pines) in 1997. The preliminary plat for Apple Ridge was
modified to eliminate this portion of Mr. Barthold's property. Therefore, the current
Comprehensive Plan retains this property for single family residential uses at rural standards.
The March 2001 Draft Comprehensive Plan proposes to include the subject property in the
MUSA expansion area in order to complete the River Pines subdivisions. The fact that 158th
Lane in River Pines 2"d Addition dead ends on the west boundary of the subject property is
problematic and presents a public safety concern since the length of this dead end is greater than
600 feet. In addition, a 66-foot wide dead end does not provide a sufficient amount of area for
the safe and efficient operation of municipal maintenance equipment, particularly snow plows.
Development of River Pines 5th Addition will extend 158th Lane to the east and then intersect
with Lithium Street NW, which is proposed to be extended from the north boundary of Apple
Ridge to the north boundary of the proposed River Pines 5th. This street extension plan will
alleviate a major issue for the Public Works Department with respect to the current 158a' dead-
end. Because the March 2001 draft Comprehensive Plan has not been adopted by the City
Council, approval of the requested rezoning will have to be conditioned on an amendment to the
current Comprehensive Plan to expand the MUSA boundary to include the subject property. The
request for a comprehensive plan amendment for an expansion of the MUSA boundary is also on
tonight's Council agenda for a decision. The Planning Commission met on September 10, 2001,
and conducted a public hearing regarding the proposed rezoning. There were no written
comments submitted to the City and there was one resident present at the hearing that opposed
the rezoning. Another resident wanted to be sure that future access was planned to the north.
The Planning Commission recommended that City Council approve the rezoning request. If City
Council approves of the comprehensive plan amendment and the rezoning, Staff is
recommending adoption of the findings of fact and introducing the ordinance to rezone the
property tonight. The rezoning ordinance will be submitted to City Council for final adoption if
and when the Metropolitan Council has approved the request for the MUSA expansion.

Councilmember Anderson inquired if the issue regarding the snowplowing problem is resolved.

Principal Planner Trudgeon replied yes, and reviewed the proposed layout of the site.

Councilmember Kurak noted that finding #10 should read will not.

Motion by .Councilmember Kurak, seconded by Councilmember Anderson, to adopt Resolution
#01-12~¢2ef adopting Findings of Fact #0588 relating to a request from Oakwood Land
Development to rezone certain property in Section 14 from R-1 Rural Residential to R-1 Urban
Residential.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, Hendriksen,
and Zimmerman. Voting No: None.

City Attorney Goodrich noted that introduction of the ordinance does not need to be contingent
upon Met Council approval.

City Council/December 11, 2001
