Councilmember Hendriksen stated that the Council could approve the March 2001 plan, the Met <br />Council could refuse the amendments and then the City has given the residents a false assurance. <br /> <br />Mayor Gamec stated that the language change regarding the Rural Preserve Area was made by a <br />vote of the City Council and it was sent to the Met Council so it would stand unless the Council <br />voted otherwise. <br /> <br />City Attorney Goodrich inquired as to what the Met Council had done with that language. <br /> <br />City Administrator Norman replied that the Met Council has stated that they will consider the <br />language as part of the amendment process. <br /> <br />Councilmember Kurak inquired if they could ratify the Comprehensive Plan with the Rural <br />Preserve Area amendment being included. <br /> <br />City Attorney Goodrich replied that the Council could approve the Comprehensive Plan <br />contingent on the Met Council accepting the Rural Preserve Area language. <br /> <br />Councilmember Kurak replied that she could agree with that. <br /> <br />Councilmember Hendriksen stated that the City has not held a public hearing on the Rural <br />Preserve Area language. When the language was voted on to be sent to the Met Council he chose <br />to abstain from the vote because his greatest concern was that it was a parliamentary tactic that <br />would not come forward. His concern was that the ultimate plan would not include the Rural <br />Preserve Area language. If the Council accepts the March 28, 2001 draft, it will not include the <br />language and if they include the language as part of the approval, then the Council will be <br />adopting something without a public hearing on that language. <br /> <br />Mayor Gamec inquired if they could include the Rural Preserve Area language and the Septic <br />System Ordinance as part of the March 28, 2001 plan. <br /> <br />City Attorney Goodrich reviewed State Statute regarding adoption of a Comprehensive Plan. As <br />it pertains to the March 28, 2001 draft, the City did conduct a public hearing as required and the <br />Statute does not state that every word in the Comprehensive Plan is subject to a public hearing. <br />If the text has been changed significantly then another public hearing should be held. The <br />question is, is the language changing significantly. <br /> <br />Mayor Gamec inquired if it was the City Attorney's opinion that the Rural Preserve Area <br />language and the Septic System ordinance can be submitted to the Met Council with the March <br />28, 2001 draft. <br /> <br />City Attorney Goodrich replied that one of the general topics has always been sewer and for that <br />reason he felt that language and the septic system ordinance could be submitted to the Met <br />Council. <br /> <br />City Council/December 11, 2001 <br /> Page 7 of 25 <br /> <br /> <br />
