Councilmember Kurak stated that the language changes to the Central Rural Preserve Area took <br />out things that residents were concerned about. She would prefer to send the language down <br />with the Comprehensive Plan, rather than without, but would do so to comply with procedures. <br /> <br />Councilmember Hendriksen replied that the language changes are an amendment to the Plan and <br />there are significant changes that would make it an amendment. A significant point was that the <br />area would not be developed for twenty years and he felt that the wording should be subject to a <br />public hearing. <br /> <br />Councilmember Anderson inquired as to what the constraints or penalties are for not adopting the <br />Comprehensive Plan in nine months. <br /> <br />Principal Planner Trudgeon replied that under State Statute, cities are required to adopt a <br />comprehensive plan nine months after receiving Met Council approval. If the City does not <br />comply with that requirement, they would be in violation of State Statute. <br /> <br />Councilmember Anderson inquired if the alignment policy would come into play. <br /> <br />City Administrator Norman replied that it could. <br /> <br />Councilmember Hendriksen stated that he did not think that the Met Council could take grants <br />away from the City, but they could impact future scores. <br /> <br />City Attorney Goodrich noted that the Met Council would have the authority to get a court order <br />to order the City to adopt a Comprehensive Plan. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to approve and adopt the <br />Comprehensive Plan approved by the Met Council on March 28, 2001, contingent upon the <br />language for the Central Rural Preserve Area being approved as well by the Met Council. <br /> <br />Further discussion: Councilmember Anderson expressed concern that the deadline just came <br />before them at this meeting. She stated that she would prefer to delay action until the next <br />Council meeting. City Administrator Norman replied that they could hold the four <br />Comprehensive Plan amendments that are included in the March 28, 2001 draft, until next week. <br />Mayor Gamec stated that he did not see why more time would be beneficial. Councilmember <br />Anderson replied that the Council had planned to handle everything at once, until today when <br />they received notification that they are up against a deadline. Councilmember Hendriksen stated <br />that the Council just went through a six-month process with a facilitator to come up with a <br />negotiated resolution to some of the issues and now all of a sudden the case before them is <br />entirely different. City Administrator Norman stated that staff could put together a formal case <br />for the next City Council meeting. <br /> <br />Motion was withdrawn. <br /> <br />City Council/December 11, 2001 <br /> Page 8 of 25 <br /> <br /> <br />
