requirements on Potassium Street would require less right-of-way acquisition than was <br />previously discussed. Community Development Director Tmdgeon replied staff believes what is <br />proposed in the plat has a fairly minimal impact with 20 feet of right-of-way on the developer's <br />property and 40 feet of right-of-way from the eastern edge of the traveled surface going west. <br />Mayor Gamec clarified that his motion would shift Potassium Street as far to the west as <br />possible, with the minimum street size. Curb and gutter would not be necessary at this time, and <br />it is not necessary to impact the residents to the east. Assistant Public Works Director Olson <br />asked if curb and gutter should be included on the west side of Potassium Street, which will not <br />re-subdivide and will not require ditches. Mayor Gamec directed staff to provide information <br />regarding the curb and gutter and drainage on the west side of Potassium Street with the final <br />plat. Councilmember Strommen questioned how this motion compares with the original <br />discussions on Potassium Street in relation to the cost and the impact to the property owners. <br />Community Development Director Trudgeon replied from his understanding the impact would <br />be similar to what is shown on the preliminary plat. Councilmember Olson noted it would not <br />include the costs associated with old CR 5. Mayor Gamec indicated some of the costs should be <br />negotiated with the developer. Councilmember Elvig stated nothing has been done for the <br />residents that the City will be negotiating with as far as including an outward bound access to CR <br />5 for the traffic. Mayor Gamec stated he would have concern ifCR 5 were to have two accesses <br />close together. <br /> <br />Motion carried. Voting Yes: Mayor Garnet, Councilmembers Cook, Jeffrey, Olson, and <br />Pearson. Voting No: Councilmembers Elvig and Strommen. <br /> <br />Community Development Director Trudgeon indicated the motion just passed was in relation to <br />the street alignment. The motion for the site plan should be contingent with compliance of the <br />City Staff Review Letter dated April 1, 2005, revised May 6, 2005, and adherence to the last <br />motion with the road alignment. <br /> <br />Motion by Mayor Gamee, seconded by Councilmember Cook, to adopt resolution #05-05-168 <br />granting contingent preliminary plat approval for the plat of Shade Tree Cottages, contingent on <br />City Staff Review Letter dated April 1, 2005, revised May 6, 2005, and contingent on adherence <br />to the previous motion regarding the road alignment. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Jeffrey, Olson, and <br />Pearson. Voting No: Councilmembers Elvig and Strommen. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Cook, to adopt resolution #05-05-169 <br />authorizing acquisition of permanent street and utility easements necessary for the improvement <br />of Potassium Street Northwest. <br /> <br />Further discussion: Councilmember Jeffrey questioned if the City has made good faith efforts to <br />negotiate with the property owners. City Attomey Goodrich replied there have not been <br />negotiation efforts made yet. The City has talked to the property owners and determined their <br />position, and an appraisal is now necessary. By law the City is required to go through good faith <br />efforts as part of these proceedings.
