When mining'operations are anticipated to be discontinued for <br />an interval greater than one working day, the slopes shall be flattened to a grade <br />no steeper than 4 feet horizontal to 1 foot vertical. <br /> <br />Prior to commencing any grading operations, a cash escrow or letter of credit <br />approved as to form by the City in the amount of Ten Thousand Dollars and no <br />cents ($10,000~00) shall be deposited with the City. This financial guarantee may <br />be used by the City to pay for the cost and expense of repairing any public fight of <br />ways or regrading and stabilizing eroded areas due to the grading operation, pay <br />for any cost associated in administering the requirements of this Chapter of the <br />City Code, and to pay for any restoration of the work site not properly restored <br />upon completion.' The Permit Holder agrees to permit access to the property by <br />the City to facilitate restoration, if necessary. <br /> <br />14. The Permit Holder shall implement sediment and erosion control practices. No <br /> grading activity shall occur within twenty-five (25) feet of a prpperty line unless <br /> silt .fence :is placed along the property line to prevent sediment from washing onto <br /> the adjoining property. Any erosion which causes gullies of greater than one (1) <br /> foot within twenty-five (25) feet of a property line shall be regraded within forty- <br /> eight (48) hours of the precipitation 'event that caused the erosion. <br /> <br />15. There shall be no stockpiling of graded materials, other than the topsoil on a <br /> temporary basis, allowed within the boundaries of the Subject Property. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />The permit holder shall file with the City a liability insurance policy or certificate <br />of such insurance acceptable to the City and issued by an insurance company <br />authorized to do business in the State of Minnesota. <br /> <br />The policy shall insure the permit holder for the sum of at least $300,000 for <br />injury to one person and $500,000 for one accident, and at least $i,100,000 <br />property damage. <br /> <br />Said policy shalI be for the full period of the permit and shall provide for the <br />giving of 30 days prior notice to the City by registered mail of termination, <br />cancellation or amendment of the policy. <br /> <br />In the event said policy is terminated for any reason, the permit shall be <br />automatically suspended upon the day the policy terminates unless a new policy <br />complying with this item is obtained and filed with the City prior to the <br />termination of the policy in force. <br /> <br />The maximum noise level at the perimeter of the work site. shall be within the <br />limits set by the Minnesota Pollution Control Agency and the Environmental <br />Protection Agency of the United States. <br /> <br />32 <br /> <br />Resohition #05-07- <br /> Page 3 of 5 <br /> <br /> <br />
