to the east. The construction of Town Center Drive north of Bunker Lake Blvd is not scheduled <br />until 2008, and no bonding has been initiated for this street. If this street is to be constructed <br />prior to 2008 staff is recommending that the developer be responsible for construction, unless a <br />temporary alternative can be agreed upon by the Developer and the City. <br /> <br />Community Development Director Trudgeon advised theTC-4a District requires two off-street <br />parking spaces for each unit; the double garages and driveways provide four off-street parking <br />spaces for each unit. The Park Commission reviewed the sketch plan on February l0th. They <br />stressed the Town Center Development guideline that encourages the use of private courtyards or <br />usable grcenspace being provided for the residents of the buildings. The preliminary site plan <br />complies with the development guidelines and provides green spaces for recreational and <br />stormwater management purposes on each block. He advised the Grading and Drainage and <br />Utility Plans have been reviewed. Necessary revisions are included in the City Staff Review <br />Letter. Staff is still receiving and reviewing updates to the drainage, grading, street, and utility <br />plans. Additional information and revisions may be required once the staff review is complete. <br /> <br />Community Development Director Trudgeon advised stormwater generated by the 8th, 9th, and <br />10"~ Additions cannot be fully accommodated on-site; part of the volume will be directed to the <br />regional stormwater pond in Town Center West Park. Staff has reviewed calculations provided <br />by the applicant; this increase in runoff will increase the area of the regional pond by 3.0 acre <br />l~cet, raising the pond level approximately 0.1 feet. He advised the proposed Landscaping Plan is <br />gcneral Iy acceptable with some minor modifications. No tree preservation plan is required, as <br />the site is void of trees. The Master Development Agreement for Town Center establishes that <br />there are no park or trail fees due on this plat. However, there is a park payment obligation on <br />thc Ist Amendment to the Master Development Agreement that requires a cash payment to the <br />City upon sale of the property in an amount equal to $750.00 times the number of eligible units <br />on thc property in accordance with the zoning regulations. <br /> <br />Community Development Director Trudgeon advised staff is recommending approval of the <br />request tbr preliminary plat and preliminary site plan approval contingent on compliance with <br />~hc City Staff Review Letter dated May 27, 2005, revised June 24, 2005. He explained the <br />developer would like to complete model homes quickly, before the final plat is approved, in <br />order to be ready for the fall Parade of Homes. The developer would like to complete five to <br /> th th <br />seven units in the 8 Addition and one building in the ~ Addition. An indemnification <br />agreement was drafted by RTC lawyers, which staff would like to review to be sure the City is <br />covered. Thc agreement would indemnify the City for a situation such as the footings being in <br />thc wrong place or the grading not working and the responsibility would be on the developer. He <br />advised there is some concern in that it is a likely chance this site will not be hooked up to <br />municipal utilities at the time of the Parade of Homes. The City Attorney would like to look at <br />thc agreement to be sure it is in compliance with City Code. If the Council is comfortable with <br />that, stal'f will follow through on the indemnification agreement. <br /> <br />Mayor Gamec asked for the City Attorney's recommendation regarding the agreement. <br /> <br />City Attorney Goodrich replied he has only looked at the agreement briefly, and would like to be <br />certain it does not conflict with City ordinances or past practices.
