CONSERVATION AND TRAIL EASEMENT <br /> <br />This is a CONSERVATION AND TRAIL EASEMENT granted by <br /> , (the "Owner") to the City of Ramsey, (hereafter <br />refen'ed to as the 'City), existing under the laws of the State of Minnesota. <br /> <br />RECITALS: <br /> <br />OWNER. The Owner is the current owner of approximately acres of real <br />property located in the City ofRamsey, Anoka County, Minnesota. That real property is <br />more fully described below as the "Protected Property." <br /> <br />PROTECTED PROPERTY. The Protected Property is that real property legally <br />described in Exhibit A and generally depicted on the "Property Map" in Exhibit B. Both <br />exhibits are attached to this Easement and incorporated by this reference. <br /> <br />The Protected Property is currently used for agricultural and residential purposes. There <br />are no improvements on the Protected Property. <br /> <br />Co <br /> <br />CONSERVATION AND PUBLIC VALUES. The Protected Property has the following <br />natural, scenic and open space qualities of significant importance: <br /> <br />· Contiguous system of wetlands and terrestrial habitat known as an alder swamp. <br />· Free flowing stream with associated biotic life. <br />· Diverse herbaceous and woody plants including aspens, oak, tamarack and other <br /> trees known as a mixed aspen forest. <br />· Identified as a critical east west trail route within the City that will connect to <br /> other communities and resources. <br /> <br />Collectively, these natural, scenic and open space qualities of the Protected Property <br />comprise its "Conservation Values." <br /> <br />These Conservation Values have not been and are not likely to be adversely affected to <br />any substantial extent by the continued use of the Protected Property as described above <br />or as authorized below or by the use, maintenance or construction of those structures and <br />improvements that presently exist on the Protected Property or that are authorized below. <br /> <br /> <br />
