She indicated development of <br />l,ot 3 cannot happen without the extension and construction of 144th Avenue NW, and City Staff <br />will verify that the easement received from Waltek for the future road corridor has been recorded. <br /> <br />Case #8 <br /> <br />Consider Revisions to Proposed Wetland Buffer Ordinance; Case of City of <br />Ramsey <br /> <br />l'rcscntation <br /> <br />Recycling and Zoning Coordinator Anderson stated at the May 5 Planning Commission meeting <br />there was ti public hearing regarding the proposed wetland buffer ordinance. He indicated the <br />Ordinance revisions reflecting the comments received at the May 5 meeting have been <br />incorporated into thc draft. <br /> <br />Recycling and Zoning Coordinator Anderson indicated that during the revision process, it came <br />to StatVs attention that the proposed ordinance did not include a structure setback from the <br />bu[Tcr edge. He stated this could pose a fire safety issue and/or eliminate any usable yard on a <br />particular lot. He indicated Staff consulted with the Fire Marshall regarding this matter and <br />determined that a setback of some distance was necessary for fire safety purposes. He stated the <br />Fire Marshall recommended a thirty foot structure setback from the buffer edge. He advised that <br />based on that recommendation and discussions with the Environmental Policy Board, Staff is <br />proposing a minimum structure setback from a buffer edge of fifteen feet. <br /> <br />Recycling and Zoning Coordinator Anderson noted he brought this recommendation back to the <br />Fire Marshall, who was okay with the fifteen foot setback. <br /> <br />Chairperson Nixt asked if the setback is from the buffer edge or the wetland. <br /> <br />Recycling and Zoning Coordinator Anderson indicated it is from the buffer edge, which is in <br />addition to thc buffer setback. <br /> <br />Chairperson Nixt stated that since the buffer setback is 50 feet, they could be looking at a 65 foot <br />setback. <br /> <br />Recycling and Zoning Coordinator Anderson indicated that was correct for the highest quality <br />dciincatcd wetlands. He stated they anticipate an average buffer would be 30 feet, so this would <br />create a 45 lbot separation. He indicated there may be areas where the buffer would be out <br />hirthcr and they could have a 65 foot setback, but they believe that will not be the case on most <br />lois. <br /> <br />Recycling and Zoning Coordinator Anderson advised both the Environmental Policy Board and <br />City StalT felt that the inclusion of a structure setback was a significant enough change from the <br /> <br />Planning Commission/July 7, 2005 <br /> Page 14 of 16 <br /> <br /> <br />
