He stated there will be tenfold the traffic coming down this street, which <br />is presently a dangerous situation. Councilmember Jeffrey indicated during the previous <br />discussion regarding the Shade Tree preliminary plat he was in favor of having Quicksilver <br />(iirclc connect to CR 5. Councilmember Pearson asked what kind of timetable this motion <br />would put on the Shade Tree preliminary plat that was already approved. City Attorney <br />(}oodrich replied the Shade Tree preliminary plat is contingent on the acquisition of Potassium <br />Street. As thc preliminary plat is presently approved, condemnation will be necessary for <br />¢otassium Street to be used by the plat. This condemnation will require approximately six <br />months to accomplish. Mayor Gamec noted in previous discussions the Council did not like the <br />idea o1' the longcr cul-de-sac in this plat. However, there is a lift station that would be eliminated <br />il' thc cul-de-sac is continued. Civil Engineer II Linton explained given the contingency of first <br />right ol' refusal in the motion, it would not close the door on eliminating the lift station, but <br />would push it out a little longer. Councilmember Cook questioned how the Council can back up <br />on thc Shade Tree preliminary plat, which has been granted preliminary plat approval. He stated <br />during thc discussion of the Shade Tree preliminary plat it was noted that it was not a benefit to <br />the City to have Quicksilver Circle go through, which would add another access onto CR 5. This <br />motion would go back on that preliminary plat to negotiate on a project that will allow water and <br />sewer to go through and eliminate lift stations. He stated this almost seems like a lose/lose <br />situation. Community Development Director Tmdgeon advised the Shade Tree preliminary plat <br />was approved with contingencies. Shade Tree is aware of the possibility of revisiting the idea of <br />Ouicl<silvcr Circle going through, and did not offer an opinion to him regarding this. <br />(!ouncilmcmber Elvig stated extending Quicksilver Circle will mitigate the traffic in the <br />neighborhoods. These residents presently only have a road on one side of their homes, and this <br />plat would change that to three sides of their homes. He stated he would suggest staff start <br />negotiating first right of refusal on the four properties on the northeast comer of Alpine Drive <br />and CR 5. Councilmembcr Jeffrey asked what the effect would be of limiting the development <br />at 600 feet. Steve Slettner, President of Technical Design, stated he is present to represent the <br />developer. Itc indicated Lots 1 through 8 and 16 through 19 could be served with the 600 feet <br />ii,eluded in the motion. If the end of the cul-de-sac is used, bubble lots 9 and 20 could be served <br />with thc temporary cul-de-sac. He agrees there is one lift station that would be eliminated if this <br />project goes through. Regarding the right of refusal, if that right of refusal does not happen the <br />developer cannot afford to build a 600 foot street and end with Phase 1. The developer would <br />like to give the City time to obtain that first right of refusal. However, if the first right of refusal <br />cannot be gained within approximately six months, the developer could come back for approval <br />on l'hasc 2, which would be lots 10 through 15, 21 22 and 23. He stated the whole project is <br />needed to make this work. Councilmember Cook stated the long cul-de-sac is of mutual benefit <br />to thc City and the developer. The City should try to obtain first right of refusal on the properties <br />suggested, but that is the City's responsibility, not the developer's. He stated he agreed with not <br />extending Quicksilver Circle out to CR 5 with the preliminary plat of Shade Tree. He would not <br />support thc motion on the floor, and he would support moving this plat on the way it is designed. <br />Mayor Gamec stated he sees a benefit in the long cul-de-sac with the developer picking up the <br /> <br />City Council / July 12, 2005 <br /> Page 6 of 25 <br /> <br /> <br />
