If the Council will be adopting findings they <br />should be considered prior to any motion. <br /> <br />Counci Imembers Elvig and Jeffrey withdrew the motion on the floor. <br /> <br />Motion by Councihnember Elvig, seconded by Councilmember Jeffrey, to approve Resolution <br />//05-07-203 adopting Findings of Fact #0726 in support of the preliminary plat of Rum River <br />Estates. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Elvig, Jeffrey, Cook, Olson, and <br />Pearson. Voting No: None. Absent: Councilmember Strommen. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Jeffrey, to adopt a resolution <br />granting contingent preliminary plat approval of Rum River Estates with contingency #3 <br />amended to include curb and gutter on the west side of Potassium Street, and that the following <br />motion adopted by the Council on June 14, 2005, to-wit: <br /> <br />That thc tbllowing street alignment be incorporated for the preliminary plat and site plan <br />approval of Shade Tree Cottages: Keep the general alignment of Potassium Street with <br />the street moved as much as possible to the west, to improve Potassium Street to a <br />minimum standard width with a minimum impact. <br /> <br />Be R I!S(;INDED and replaced with the following motion to-wit: <br /> <br />Staff is directed to negotiate first rights of refusal with the property owners of the four <br />properties located on the NE comer of County #5 and Alpine Road for purposes of <br />acquiring roadway easements for a routing from Potassium to Alpine with the goal being <br />thc eventual closing of all accesses on County #5 from 157th to Alpine Road. <br /> <br />l"urther discussion: Mayor Gamec asked if the curb could be rolled on the west side of <br />Potassium Street. Assistant Public Works Director Olson replied that is what staff hoped to do. <br />~]'hc reasoll for thc ;/8 foot width was so the curb could be put in permanently. If storm sewer is <br />installed the catch basin would be located where the curb is. Councilmember Cook stated this <br />motion has a lot of contingencies and the Council just passed findings for approval. The issues <br />in these contingencies are based on circumstances outside of the actual subdivision. He <br />qucslioncd what would happen if on September 1, 2005 the City does not have acquisition of <br />land l'or Potassium Street. He stated this would be holding the developer up for things that are <br />far out of his reach. City Attorney Goodrich advised Potassium Street is essentially serving this <br />property, and the development cannot go forward without the street being resolved. The Shade <br />Trcc preliminary plat is contingent on the acquisition of Potassium Street. Councilmember Cook <br />stated this developer said he would not start construction until 2006. There are several things <br />that could Fall through with these contingencies, such as Potassium Street and the developer of <br />Shade '['rce not agreeing to the extension of Quicksilver Circle. They will then be back to the <br />table with this again in September. Councilmember Elvig stated at some point in time the City <br />has to look at what they are doing to the surrounding neighborhoods. <br /> <br />City Council / July 12, 2005 <br /> Page 9 of 25 <br /> <br /> <br />
