That the Subject Property received preliminary plat approval as Sweetbay Ridge on August <br />23, 2005 and consists of 158 single family urban residential lots served by sanitary sewer and <br />municipal water. <br /> <br />6. That the August 23, 2005 preliminary plat approval was conditioned on the Applicant <br /> obtaining a variance to the front yard setback requirements. <br /> <br />7. That the special conditions causing the undue hardship, namely the presence of wetlands and <br /> substantial tree cover, do/do not result from the actions of the Applicant. <br /> <br />8. That if granted, the variance will/will not grant the Applicant any special privilege that is <br /> denied to other owners of lands, structures or buildings in the same district. <br /> <br />9.
