CASE # <br /> <br />CONSIDER APPROVAL OF ACQUISITION OF EASEMENTS FOR THE NW <br />TRUNK SANITARY SEWER E~TENSION <br /> By: Brian Olson, Assistant Director of Public Works/Principal City Engineer <br /> <br />Background: <br /> <br />The City Council authorized Bolton & Menk, Inc to begin design of the infrastructure for <br />extension of sewer and water to petitioning properties on May 11, 2004. The costs were <br />to be paid fi:om the respective enterprise funds and be reimbursed fi:om the bond proceeds <br />when and.if the projects were approved. <br /> <br />The City Council directed staffto implement a pubtic participation program on December <br />6, 2004. The program included property owners in the area identified as the NW Sewer <br />Extension. <br /> <br />The City held an informational meeting on February 7, 2005 with residents that could be <br />impacted by sewer and water extension. There were five (5) alignments under <br />consideration and all residents adjacent to the proposed alignments were invited to <br />participate in the meeting. <br /> <br />The City Council concurred with the Staffrecornmendation that Option 3 be selected as <br />the alignment for this sewer extension at a work session March 15, 2005. The <br />recommendation was based on review of the advantages and disadvantages of each <br />alignment and consideration of public comments received. <br /> <br />The City Council selected the alignment on April 12, 2005. Staffwas directed to notify <br />residents adjacent to Alignment No. 3 on June 9, 2005. The purpose of this notification <br />was to begin the process of acquiring the easements necessary for construction of the <br />sewer and water lines. The majority of the properties need to be acquired before issuing <br />the bids for the project. <br /> <br />The City Council authorized staff to retain Tinklenberg Group and Prosource <br />Technologies on August 23, 2005. These firms will contact each property owner <br />individually, negotiate the necessary easement and prepare the necessary documents to <br />transfer the easements to the city. <br /> <br />On September 27, 2005, the City Council approved the .completed negotiations for 10 <br />parcels along the project. <br /> <br />On November 22, 2005, the City Council approved an additional 8 parcels along the <br />project and we were able to slightly modify the project to keep the limits of construction <br />within existing drainage and utility easements for an additional 5 parcels. <br /> <br />On December 13, 2005, the City Council authorized the use of eminent domain for the <br />remaining parcels for the sewer line only. <br /> <br />-201- <br /> <br /> <br />
