Commissioner Nixt inquired if the City ultimately decides to repeal the Charter Amendment, <br />would this ordinance stand on it own merits. <br /> <br />City Attomey Goodrich replied yes. <br /> <br />Commissioner Nixt stated that the ordinance should then be developed on its own merits. <br /> <br />Paul Zisla, representing Marlene Katnis, stated that there are going to be cases where the 1,000 <br />buffer area will be difficult to achieve. He explained that the Katnis property is currently zoned <br />commercial, but the proposed Comprehensive Plan indicates the property as high density <br />residential. If the proposed ordinance were to be adopted, it would only allow for the property to <br />be developed with single family homes which is inconsistent with the proposed Comprehensive <br />Plan. The Katnis property has been sold to Orrin Thompson Homes and the concept plan <br />includes 2.75 acres of park land buffer and then after that park area it shows high density <br />residential townhomes. <br /> <br />Mike Black, land developer for Royal Oaks, stated that he purchased the Laws Property and is in <br />a very similar situation as the Katnis property. He explained that he has been an urban planner <br />since 1973, and a member of the American Planning Association since 1980. This ordinance <br />would have a harmful impact on the value of his land since they are proposing to develop the <br />property with mixed density and another senior citizen three story building directly across from <br />the existing senior housing complex. He stated that they have not objected to the proposed <br />Comprehensive Plan, but this ordinance would affect that. If the City were to require the 1,000 <br />foot buffer, it would be a significant deduction of what they would be allowed to build, but if <br />Paragraph F of the proposed ordinance allows a developer to come forward with a PUD then he <br />would not be as concerned with the ordinance. <br /> <br />City Attorney Goodrich replied that Paragraph F is not intended to change the density <br />graduation. <br /> <br />John Aune, Orrin Thompson Homes, stated that they are opposed to the ordinance. <br /> <br />Craig Schinzel, 15664 Juniper Ridge Drive NW, Ramsey, stated that currently the City is doing a <br />moderate redesign of T.H. #47, but it is his understanding that north of 153ra Avenue, T.H. #47 <br />will not be upgraded. With the stream of traffic coming down T.H. #47 the high density <br />development, he would not be able to get out of his neighborhood onto T.H. #47, and thinks all <br />the main highways need to be considered before there is any further development. <br /> <br />Commissioner Dempsey noted that all the developments mentioned are south of 153rd Avenue. <br /> <br />Mr. Schinzel questioned if there is any guarantee that there will be no development north of him. <br />City Attorney Goodrich replied no. <br /> <br />Planning Commission/July 10, 2000 <br /> Page 10 of 20 <br /> <br /> <br />
