applicant and RV Wholesalers will be notified that the temporary structure will need to be <br />removed from the property. The site plan and staff review letter has been forwarded to the City <br />Attorney to address the appropriateness of the use of the sedimentation pond as a discharge point. <br /> <br />Commissioner Nixt inquired about the legal concerns regarding draining into the adjacent <br />sediment pond. <br /> <br />City Attomey Goodrich explained that from a legal standpoint, the sediment pond is a public <br />facility and can be used for drainage. <br /> <br />Community Development Director Frolik noted that the sediment pond is located on the Deal <br />property and was required by the City when their building was constructed. <br /> <br />City Attorney Goodrich stated that it is not a legal issue, but more of an issue is it fair to require <br />that one property owner give up a portion of their property for a sedimentation pond and not <br />require the same of another property owner. <br /> <br />Commissioner Johnson inquired as to how the sedimentation pond was sized. <br /> <br />City Attorney Goodrich replied that the pond was sized to serve the Deals property. <br /> <br />Community Development Director Frolik noted that the City Engineer was comfortable with the <br />capacity of the pond, but was concerned about the legality. <br /> <br />Ivan Clauson, City Wide Door, stated that he discussed the issue with the owner of Pro-Sports <br />and he had indicated that if the City does not have problem with their property draining into the <br />pond, then he did not have a problem. <br /> <br />Commissioner Nixt stated that he would like an analysis to show that the pond could handle the <br />Deal property if it was fully developed, as well as the City Wide Door property. <br /> <br />Commissioner Kociscak inquired if the City could require City Wide Door to construct their own <br />sedimentation pond if the adjacent pond could not handle the capacity. <br /> <br />Community Development Director Frolik replied yes. <br /> <br />Commissioner Kociscak questioned the comments made in the City Staff Review letter regarding <br />the loading dock. <br /> <br />Staff reviewed the location of the loading dock. <br /> <br />The Commission was comfortable with the proposed loading dock, but requested clarification of <br />dimensions by the time it is presented to Council. <br /> <br />Planning Commission/August 1, 2000 <br /> Page 10 of 13 <br /> <br /> <br />
