Motion by Board Member Dempsey, seconded by Board Member Nixt, to close the public <br />hearing. <br /> <br />Motion carried. Voting Yes: Chairperson Anderson, Board Members Dempsey, Nixt, Jensen, <br />Johnson, and Kociscak. Voting No: None. Absent: Wivoda. <br /> <br />The public hearing closed at 8:08 p.m. <br /> <br />Board Business <br /> <br />Chairperson Anderson called the regular meeting of the Board of Adjustment back to order at <br />8:08 p.m. <br /> <br />Community Development Director Frolik noted that if a lot is not in common ownership with an <br />adjacent lot, the lot is considered buildable no matter what the width of the lot is. <br /> <br />Board Member Johnson inquired if someone could build on a flood plain lot. <br /> <br />Community Development Director Frolik explained that there are certain codes that have to be <br />followed in order to construct a home on a flood plain lot. <br /> <br />Board Member Johnson inquired as to other ways to deal with common lot regulations. <br /> <br />Community Development Director Frolik replied that the vacant lot could be sold or conveyed to <br />a builder to construct the home at which time the lot would be considered buildable. Ms. Frolik <br />also noted that Mr. Lien did get a variance and his lot is 80 feet wide. <br /> <br />Board Member Nixt stated that lots of record as of 1985 are eligible for a variance, but if there <br />has been an amendment to the Boyum lots since 1985, is it still eligible for the variance. He <br />requested that the City Attorney review the information and give his opinion. <br /> <br />Board Member Johnson stated that his concern is in regards to the home that was rebuilt which is <br />creating the congestion on the properties. If the new home is constructed it will have a large <br />impact on the Larsen's. <br /> <br />Board Member Nixt feels there is a congestion problem that was contributed to by the <br />landowner. <br /> <br />Mr. Boyum stated that the reason he did not move the entire existing home was due to financial <br />reasons. By rebuilding on the existing foundation he was able to save a considerable amount of <br />money. He also noted that another reason for the congestion is because the Larsen's house is not <br />centered on their property. Mr. Boyum expressed that he would like to have a building permit <br />before April 15th because there will be new regulations on energy and the cost of construction <br />will go up approximately $7,000. <br /> <br />Board of Adjustment/February 1, 2000 <br /> Page 6 of 7 <br /> <br /> <br />
