proposing changes to the ordinance by Connexus have been reviewed by himself (Jankowski) the <br />Director of Public Works, the City Attorney. The Committee was presented with a draft showing <br />the modifications to the originally introduced ordinance. <br /> <br />Councilmemb er Hendriksen questioned the implications of section 4.10.08 (2) on p age 9. <br /> <br />City Engineer Jankowski replied that the City Attorney reviewed the wording and commented <br />that by adding the proposed wording it places an additional obligation on the City. <br /> <br />Councilmember Zimmerman replied that it should not be the City's responsibility. <br /> <br />Consensus of the Committee was to change the wording to read "The City will maintain a list <br />which will be available upon request." <br /> <br />City Engineer Jankowski stated that on page #4 under definition of Right-of-Way, the utility <br />company proposed language which would exempt the drainage and utility easements located <br />adjacent to the right-of-way from inclusion in the definition of the fight-of-way. Staff felt that <br />the City should keep control of the easements. <br /> <br />Councilmember Hendriksen questioned why the easements would be excluded. <br /> <br />City Engineer Jankowski explained that the easements are not technically a part of the right-of- <br />way but the City could exercise the fight over that. <br /> <br />Consensus of the Committee was to keep the wording as originally proposed. <br /> <br />City Engineer Jankowski noted that on page #11, Section 4.10.12 is unclear to staff, but staff has <br />been unable to address the issue with Connexus. <br /> <br />Councilmember Zimmerman requested that staff have clarification from Connexus before the <br />next City Council meeting. <br /> <br />City Engineer Jankowski stated that on page #24, Section 4.10.29(2) Connexus has proposed <br />changing the responsibility of relocation on the City. This suggested change begs a policy <br />decision. <br /> <br />Motion by Councilmember Hendriksen, seconded by Chairperson Zimmerman, to recommend to <br />table the issue at the Committee level and refer to the City Council in order to address the issues <br />with the City Attorney. <br /> <br />Motion carried.
