City Engineer Olson replied approximately 200 to 250. <br /> <br />Councilmember Hendriksen stated that the amount of water the Pretzel property is draining into <br />the wetland is relatively insignificant and it seems that he should receive some credit for the <br />portion of the wetland that he owns. <br /> <br />City Engineer Olson replied that he did give the Pretzel property a substantial credit when the fee <br />was determined because they are only being billed for 3 acres rather than the 10 acres. He <br />suggested identifying a portion of the lot residential and a portion commercial. <br /> <br />Councilmember Hendriksen inquired if a property is 100 percent commercial and in the middle <br />of the property there is a low spot and all of the run-off goes into the low spot would they receive <br />a credit. <br /> <br />City Engineer Olson replied that if the property owner had a site survey that proved that all of the <br />run off went into the low spot and could withhold a 100 year storm then they could receive a 25 <br />percent credit. An additional 25 percent credit can be received for a wetland. <br /> <br />Councilmember Hendriksen inquired as to what would happen if the low spot is 50 percent on <br />their property and 50 percent on another piece of property. <br /> <br />City Engineer Olson replied that in his opinion they would not receive the credit, because they <br />might decide that they want the City to take over the responsibility of maintaining the low spot. <br /> <br />Councilmember Hendriksen stated that when the property line runs through the pond there is still <br />a volume of discharge contained in the property that he owns. <br /> <br />City Administrator Norman stated that the Pretzel Sanitation property owner can make <br />application for the credit and then a determination can be made as to whether or not he will <br />receive that credit. <br /> <br />Councilmember Hendriksen replied that he does not have any complaint with using the 100 year <br />storm standard, but their needs to be some kind of test to determine how much water runs off the <br />property and if that water can be held in the portion of wetland that is on the property. <br /> <br />City Engineer Olson inquired if the Committee is comfortable with having to require businesses <br />to hire a surveyor to prove their request for the credit. <br /> <br />Councilmember Hendriksen stated that he is comfortable with the burden of proof falling on the <br />business, but the application should have basic questions that can be answered so that a lot of <br />time is not spent on a case where it is very obvious that a business should receive credit. <br /> <br />City Engineer Olson stated that he felt they could come up with an acceptable situation on the <br />Pretzel property if they were to charge the property as both residential and commercial because <br /> <br />Public Works Committee/August 14, 2000 <br /> Page 6 of 9 <br /> <br /> <br />
