Motion by Councilmember Anderson and seconded by Mayor Gamec to authorize the submittal <br />of the proposed Individual Sewage Treatment Systems Grant Application to the Metropolitan <br />Council for their consideration. <br /> <br />Further Discussion: Councilmember Hendriksen believed that the application was committing <br />the City to more than he felt necessary. Mayor Gamec stated submitting the application did not <br />commit the City to accepting the grant. City Attorney Goodrich affirmed that even if the grant <br />were awarded, the City had the option to turn it down. Councilmember Hendriksen stated that <br />the language of the application commits the City to more than necessary, and if the grant were <br />approved on the basis of the application, then acceptance would obligate the City to perform in <br />compliance with the application. He felt the City should only commit to doing what is required <br />by MPCA 7080. He does not want to subject the citizens to unnecessary costs just to get the <br />grant. Discussion ensued regarding rewriting the application. <br /> <br />Councilmember Anderson and Mayor Gamec agreed to withdraw the motion. <br /> <br />Motion by Councilmember Hendriksen and seconded by Councilmember Connolly to authorize <br />the submittal of the proposed Individual Sewage Treatment Systems Grant Application to the <br />Metropolitan Council, amending the Scope of Management section to read "For implementing a <br />system that complies with MPCA 7080." <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Connolly, Anderson, <br />and Zimmerman. Voting No: None. <br /> <br />Case #9: <br /> <br />Consider Entering into Agreements with MnDOT Relative to T.H. #47 STP <br />Project <br /> <br />City Engineer Jankowski stated MnDOT has presented the City with two agreements relative to <br />the T.H. #47 STP project. The first agreement, Agency Agreement No. 80003, allows the City to <br />administer the project under the Delegated Contract Process and outlines the City's <br />administration responsibilities and the procedure for handling payments, along with <br />acknowledging certain Federal, State, and Local laws with which this project must comply. <br />Partnership Agreement 79780-P gives back the technical responsibilities to MnDOT. It also <br />pledges MnDOT into absorbing the construction engineering costs of the project, estimated at <br />$256,000. It also acknowledges that MnDOT will be reimbursed for their technical services <br />associated with the related projects of Sunwood Drive and City sanitary sewer and water, in the <br />approximate amount of $60,000. Mr. Jankowski noted that both agreements contain a <br />cancellation clause which, although may be objectionable, is required by state statutes. <br /> <br />Councilmember Zimmerman inquired whether the City could have had its own construction <br />engineers do the inspections, and Mr. Jankowski replied yes, but it saves the City $256,000 to <br />have MnDOT do it. <br /> <br />Mr. Jankowski discussed how the cash flow for the project will work, and it was also mentioned <br />that the liability for the project is the City's. <br /> <br />City Council/March 14, 2000 <br /> Page 10 of 18 <br /> <br /> <br />
