Motion by Councilmember Zimmerman and seconded by Councilmember Hendriksen to adopt <br />Resolution #00-03-057 authorizing the City to enter into Agency Agreement No. 80003 with <br />MnDOT relative to the T.H. #47 STP project. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Hendriksen, <br />Anderson, and Connolly. Voting No: None. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Hendriksen to adopt <br />Resolution #00-03-058 authorizing the City to enter into Partnership Agreement 79780-P with <br />MnDOT relative to the T.H. #47 STP project. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Hendriksen, <br />Anderson, and Connolly. Voting No: None. <br /> <br />Case #10: <br /> <br />Consider Adoption of an Amended Resolution Authorizing the Acquisition of <br />the BMA Property by Eminent Domain <br /> <br />City Attorney Goodrich explained that Council adopted Resolution #99-02-045 in February <br />1999, authorizing the acquisition of the 150-acre BMA property by eminent domain or by direct <br />negotiation. To date, negotiations have not produced a successful result and, therefore, eminent <br />domain legal action will proceed. However, since the adoption of Resolution #99-02-045, the <br />public purpose of locating the Anoka Hennepin Technical College campus on site is no longer <br />available to the City. In addition, locating a transportation center for the Northstar Corridor <br />Development Authority is questionable at this time, and legal counsel deems it advisable not to <br />include this as a public purpose. These changes therefore require amendment of the original <br />resolution for this project. Mr. Goodrich advised that he has filed a Petition to amend the <br />Complaint, and he recommends adopting a new resolution and amending the Complaint. He <br />stated he was confident the City still has proper public purpose that will fall under purposes for <br />condemnation. <br /> <br />Discussion ensued regarding intent for acquiring the property. <br /> <br />Motion by Councilmember Hendriksen and seconded by Councilmember Anderson to adopt <br />Resolution #00-03-059 authorizing acquisition of property for industrial park development <br />purposes. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Anderson, Connolly, <br />and Zimmerman. Voting No: None. <br /> <br />Case #11: <br /> <br />Termination of Development Agreement with Anoka Electric Cooperative, <br />Inc. <br /> <br />City Administrator Norman advised that the City received a letter from Anoka Electric <br />Cooperative (dba Connexus Energy) requesting termination of two agreements. The agreements <br />were for developing and marketing AEC Energy Park, which is now fully developed.
