Voting No: None. <br /> <br />Case #3: Request for Final Plat Approval of West Radium Business Center <br /> <br />City Planner Rasmussen explained that H&P Development proposes a subdivision containing 2 <br />lots to be known as West Radium Business Center First Addition. The area to be platted is <br />located southwest of the intersection 140th Avenue and Radium Street. Both lots meet the <br />minimum requirements for lot size and dimensions. The plat proposes three public access points <br />fi'om existing streets. Lots 1 and lA will have access on 140th Avenue as well as a shared access <br />point along Radium Street. Lots 2 and 2A will access from the shared access point on Radium <br />Street in addition to an access point in the southeastern, portion of the property. Standard <br />drainage and utility easements are provided along all property lines with the exception of the <br />common property line. The reason for this is to facilitate a proposed paved area along this line, <br />and staff finds this acceptable. The Planning Commission and City staff recommend final plat <br />approval. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Connolly to adopt <br />Resolution #00-03-054 granting final plat approval to West Radium Center First Addition. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #4: Request for Exception to Moratorium; Case of Royal Oaks Realty, Inc. <br /> <br />City Planner Rasmussen stated Royal Oaks Realty, Inc. has purchased land for the purpose of <br />building a new mixed-residential development. The property, generally referred to as the Laws <br />Property, is west of Nowthen Boulevard. The concept plan proposes single family homes, <br />detached townhomes, attached townhomes, and apartment buildings. A majority of the property <br />is subject to the moratorium in effect until February 16, 2001. The developer would like to <br />proceed with the application process for rezoning to Planned Unit Development (PUD), <br />subdivision, and site plan. Since staff cannot accept any applications for property subject to the <br />moratorium, Royal Oaks Realty is requesting an exception to the moratorium. The plan for low <br />density residential on the western portion of the property and high density residential on the <br />eastern portion complies with the draft Comprehensive Plan approved by City Council on <br />December 21, 1999. Additionally, the westernmost portion of the property is no longer subject <br />to the moratorium. Staff recommends approval of the request for an exception to the <br />moratorium. <br /> <br />Councilmember Anderson stated she takes serious exception to the high-density apartments. <br /> <br />Councilmember Hendriksen questioned the City Attorney as to how the Planning Commission <br />would proceed with the application if the exception were allowed. <br /> <br />City Council/March 14, 2000 <br /> Page 5 of 18 <br /> <br /> <br />
