Silt fence and other erosion control measures should be <br />required to protect adjacent properties. The revised grading would not affect existing drainage <br />patterns. The Planning Commission held a public hearing at their March 6, 2000 meeting. There <br />was no written or verbal comments submitted. <br /> <br />Motion by Councilmember Connolly, seconded by Councilmember Zimmerman, to adopt <br />Resolution #00-03-073 adopting Findings of Fact # 0511 relating to North Fork's request for a <br />grading permit on Lots 3 and 4, Block 2, Northfork Lake Addition. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Connolly, Zimmerman, Anderson <br />and Hendriksen. Voting No: None. <br /> <br />Motion by Councilmember Connolly, seconded by Councilmember Zimmerman, to approve <br />North Fork's request for a grading permit based on the findings of fact and adopt Resolution #00- <br />03-074 declaring terms of same. <br /> <br />Motion carried. Voting Yes: Mayor Garnet, Councilmembers Connolly, Zimmerman, <br />Anderson, and Hendriksen. Voting No: None. <br /> <br />Case #4: <br /> <br />Request to Amend Conditional Use Permit for Outdoor Recreational Uses <br />for Diamonds Sports Bar; Case of Diamonds Sports Bar & Grill, Inc., <br />(continued) <br /> <br />City Attorney Goodrich proposed to add the following conditions to item #9 in the Conditional <br />Use Permit, which the applicant has agreed to: <br /> <br />With regard to the splat ball use, the following specific conditions shall apply: <br /> a) The hours of operation shall be 10:00 a.m. to dusk seven days a week. <br /> b) Any lights in the splat ball area will require City Council approval after a public <br /> hearing is held. <br /> c) No intoxicated participants shall be allowed to participate. <br /> d) The splat ball use shall require an additional $1,000,000 public liability insurance <br /> policy as approved by the City Attorney. <br /> e) The City, at its discretion, may review the splat ball use in the event it receives <br /> frequent complaints about the noise level from the use. This review procedure shall <br /> be the same as the conditional use permit revocation procedure of Chapter 9 of the <br /> City Code. Excessive noise complaints shall be cause for revocation of the splat ball <br /> use. <br /> f) Because of this unique use, with no previous history in the City, the City reserves the <br /> right to revoke the splat ball use in the event it finds the use is either harmful to the <br /> public health and welfare and or the quiet enjoyment and use of neighboring <br /> properties.
