Absent: None.

Case 7a: Building Permit for Accessory Buildings at 15631 Ramsey Boulevard NW

Councilmember Hendriksen excused himself from the Council.

Community Development Director Frolik stated Councilmember Hendriksen received a building
permit on March 28, 2000, for a 612 square foot accessory building. The remaining allotment of
garage or accessory building space allowed on Councilmember Hendriksen's property under the
current ordinance is 676 square feet. In addition, in 1984, the City issued Councilmember
Hendriksen a variance to exceed the allowable accessory building space on his property for two
structures totaling 1,438 square feet (1,152 square foot machine shed and 286 square foot loafing
shed). The loafing shed was built but the remaining 1,152 square feet of the variance was never
utilized. She explained that Staff did not properly notify him of an expiration date (12 months of
issuance unless an extension is granted) and, therefore, feel he is entitled to retain it as an
effective variance. With the 1,152 square feet and remaining 676 square feet approved, she
would direct the Building Official to review a building permit.

Mayor Gamec stated that in the past a request to grant an extension has been approved if notice
was not properly provided.

Community Development Director Frolik stated Staff did not notify and she would recommend
making the terms of approval to be a standard term in the development agreements.

Councilmember Anderson asked if Councilmember Hendriksen is being treated like any other
citizen of Ramsey.

Community Development Director Frolik stated she would make the same recommendation for
any other resident who was not properly notified.

Motion by Councilmember Zimmerman and seconded by Councilmember Connolly to approve
an extension to the 1984 variance to exceed the allowable accessory building space at 15631
Ramsey Boulevard NW, for a total building square footage not to exceed 1,828 square feet
(1,612 square feet if he does not remove the 216 square foot accessory building) in accordance
with his plot plan that was attached to his building permit application dated and received by the
City on March 23, 2000.

Motion carried.
