Case#5: Adopt Ordinance for Sale of Lot 1, Block 1, Business Park 95 Eighth <br /> Addition to Mateski LLC/Systematic Refrigeration <br /> <br />City Attorney Goodrich explained the City Charter requires that an ordinance be passed in order <br />to convey title to real property. Pursuant to the TIF Agreement, the City has conveyed title to <br />Mateski LLC/Systematic Refrigeration for Lot 1, Block 1, Business Park 95 Eighth Addition <br />and, therefore, it is necessary to pass an ordinance. The City has previously, by entering into the <br />development agreement on this project, approved the sale. The ordinance was introduced at the <br />April 11, 2000, meeting and it is now being presented for formal adoption. <br /> <br />Motion by Councilmember Hendriksen and seconded by Councilmember Connolly to adopt <br />Ordinance//00-07 providing for the sale of Lot 1, Block 1, Business Park 95 Eighth Addition. <br /> <br />Roll Call Vote: <br /> <br />Councilmember Anderson - aye <br />Councilmember Zimmerman - aye <br />Councilmember Connolly - aye <br />Councilmember Hendriksen - aye <br />Mayor Gamec- aye <br /> <br />Motion carried. <br /> <br />Case//6: Adopt Right-of-Way Ordinance <br /> <br />This Case was tabled upon adoption of the agenda. <br /> <br />Case #7: <br /> <br />Review Request for Preliminary Plat Approval of Valley View; Case of Philip <br />Johnson <br /> <br />Community Development Director Frolik explained that Philip Johnson appeared before the <br />Planning Commission on April 4, 2000, requesting preliminary plat approval to plat two (2) <br />existing homes on 38.7 acres in the rural residential district into four (4) single family lots. Mr. <br />Johnson originally purchased the property from his father-in-law, Wayne Davis. Mr. Johnson <br />recently sold his home on what is shown as Lot 4 to his cousin and built a new home on what is <br />proposed as Lot 1; his brother-in-law, Wayne Davis's son, would like to build his home on Lot 2. <br />The property is located north of Green Valley Road on the west side of 178th Lane NW. At the <br />City Council meeting on April 25, there was a discussion similar to that of the Planning <br />Commission on April 4. The issue of whether or not 178th Avenue N.W. should be extended to <br />the westerly limits of Mr. Johnson's plat to facilitate future development to the west was <br />discussed. The City Council reviewed and sent the preliminary plat back to the Planning <br />Commission with a request to verify whether or not provisions should be made for the future <br />extension of 178th Avenue to the west based upon a reasonable development plan for the adjacent <br />parcel to the west. Staff met with the applicant and adjacent landowner to the west on Monday, <br />May 1, 2000, to conduct another site inspection.
