Mr. Hanson stated until the MN Pollution Control Agency and the Environmental Quality Board <br />issues permits, the City is forbidden from granting building permits. <br /> <br />Councilmember Hendriksen asked for the rationale behind Mr. Hanson's opinion regarding a <br />fence around the pond. <br /> <br />Mr. Hanson stated there are safety concerns since a pond is a "child magnet." He noted any <br />waste product and paper debris would accumulate in this pond. He added that when the pond <br />dries up, the trash would be free to blow around. <br /> <br />Mayor Gamec stated if something like that were to happen, the City would investigate. <br /> <br />Mr. Hanson stated the Statute requires that in a situation where it might get out of control, a <br />fence is needed to contain the debris. He noted visually trees are nice, but he is not sure trees <br />would survive. <br /> <br />Councilmember Hendriksen stated if Mr. Hanson is concerned about the debris, would not the <br />proposed location answer these concerns. <br /> <br />Mr. Hanson stated he is concerned about truck oils. He added this is not being used for <br />accumulation. Mr. Hanson stated it is not holding pond, but a settlement pond. <br /> <br />Mayor Gamec stated the PCA must state something about this. <br /> <br />Community Development Frolik stated she does not have a copy of the conditional use permit <br />from the City. <br /> <br />Councilmember Hendriksen stated that perhaps there is some language that could be added as a <br />maintenance guarantee. <br /> <br />City Attorney Goodrich stated the language "maintain the aesthetics" could be added. <br /> <br />Mayor Gamec asked why not add the language here as well as in the conditional use permit. <br /> <br />Mr. Berkopec stated it is in the conditional use permit already. He noted if the City wants to put <br />it here as well that would be all fight. He read the language in the conditional use permit. <br /> <br />Mayor Gamec stated the current language pretty well covers it. <br /> <br />Councilmember Connolly asked if there is fencing on the other ponds. <br /> <br />City Engineer Jankowski stated many of the ponds are not fenced. <br /> <br />City Council/May 23, 2000 <br />Page 15 of 36 <br /> <br /> <br />
