Staff's recommendation, a rezoning to Planned Unit Development has been applied for. The <br />applicant is proposing 58 townhomes and 32 four-plex units that will result in a density of six <br />units per acre. In keeping with the text relating to high density residential in the draft <br />comprehensive plan, detached townhouse units are proposed on the perimeter of the plat abutting <br />adjacent single family lots in the Flintwood PUD. Also enclosed is a memo fi'om City Attorney <br />Goodrich with a legal opinion regarding whether or not the proposal is in compliance with the <br />City Charter. The City Code requires a site plan review for the quadhomes; no site plan review is <br />required for detached townhomes and twinhomes. However, the City recaptures the opportunity <br />to review development aspects relating to the townhomes and twinhomes such as architectural <br />standards, off-street parking, structure setbacks, landscaping, etc., as part of the rezoning process. <br />Community Development Director Frolik explained that City Staff and the Planning <br />Commission recommend approval of the Preliminary Plat for Mallard Ponds contingent upon <br />compliance with City Staff review letter dated May 18, 2000. <br /> <br />Motion by Councilmember Hendriksen and seconded by Councilmember Connolly to approve <br />the preliminary plat of Mallard Pond contingent upon compliance with City Review letter dated <br />May 18, 2000. <br /> <br />Further discussion: Councilmember Zimmerman asked if it is a right-in only off CR #116. Mr. <br />Bulow stated the County is only allowing a right-in and right-out. He noted there is enough <br />spacing for full access until a median is there. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Connolly, Anderson, <br />and Zimmerman. Voting No: None. Absent: None. <br /> <br />Case #9: Selection of Consultant to Review City Ordinance on Personal <br /> Communication Towers <br /> <br />Community Development Director Frolik explained that due to the recent Conditional Use <br />Permit application by US West Wireless to construct a 180 foot personal communication tower <br />in the Rural Residential District, the City Council directed the Planning Commission to review <br />the City's current ordinance. The Planning Commission has looked at the ordinance and the <br />primary concerns regarding towers are appropriate locations and heights, especially in residential <br />districts. The Planning Commission has recommended that the City Council allocate funds to <br />engage the services of a consultant to analyze the City's current tower ordinance, make <br />recommendations for any amendments deemed appropriate, and research the feasibility of <br />predetermining appropriate tower zones or locations. Staff has obtained four quotes for an <br />analysis of Ramsey's tower ordinance to include researching the legality of prescribing locations <br />for towers, identifying those locations, and drafting any ordinance amendments deemed <br />necessary.
