Motion by Councilmember Anderson, seconded by Councilmember Connolly, to add #20 to the <br />findings of fact stating "That residents living in the adjacent surrounding properties have testified <br />to developer promises of development of homes on lot sizes similar to their own on lots of one <br />acre or more on the subject property". <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Connolly, Hendriksen, <br />and Zimmerman. Voting No: None. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Connolly, to add #21 to <br />the findings of fact stating "That the residents have testified that the original unapproved <br />preliminary plat of the subject property and proposed subdivision of the subject property into one <br />acre lots." <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Connolly, Anderson, <br />and Zimmerman. Voting No: None. <br /> <br />Councilmember Anderson proposed changing finding of fact #8 to read "The proposed rezoning <br />is in compliance with the 1993 Comprehensive Plan amendment although the adjacent properties <br />to the west, north, and east were developed on one-acre and larger lots prior to inclusion in the <br />MUSA and are served by private septic systems and wells." <br /> <br />City Attorney Goodrich agreed with the proposed change to findings of fact #8. <br /> <br />Councilmember Hendriksen stated that the wording "..the proposed rezoning is in compliance.." <br />seems to be too broad of a statement and suggested using the wording "..may be in <br />compliance..". <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Connolly, to amend #8 of <br />the findings of fact to read "The proposed rezoning may be in compliance with the 1993 <br />Comprehensive Plan amendment although the adjacent properties to the west, north, and east <br />were developed on one acre and larger lots prior to inclusion in the MUSA and are served by <br />private septic systems and wells." <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Connolly, Hendriksen, <br />and Zimmerman. Voting No: None. <br /> <br />Councilmember Anderson stated that #15 of the findings of fact should be deleted. <br /> <br />City Administrator Norman agreed that #15 should be removed from the findings of fact. <br /> <br />City Attorney Goodrich noted that the finding is part of the record because the City received a <br />petition fi'om the residents regarding the traffic. <br /> <br />City Council/September 13, 2000 <br /> Page 10 of 19 <br /> <br /> <br />
