City Administrator Norman replied that the finding should read that "Testimony has been <br />received that...". <br /> <br />City Attorney Goodrich suggested adding the wording "The City has received a petition from the <br />adjoining neighborhood .... "to finding of fact #15. <br /> <br />Motion by Councilmember Zimmerman, seconded by Mayor Gamec, to amend #15 of the <br />findings of fact to read "The City has received a petition from the adjoining neighborhood that <br />one available outlet from the subject property to Highway #47, the main thoroughfare serving the <br />subject property, is via 156th Avenue NW, which is a non-signalized intersection. This <br />intersection is not sufficient to accommodate the traffic from the proposed development in a safe <br />manner." <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Anderson, <br />Connolly, and Hendriksen. Voting No: None. <br /> <br />Councilmember Hendriksen inquired if the Charter traffic issues should be included as one of the <br />findings of fact. <br /> <br />City Attorney Goodrich replied that he would not object to including the requirement of the City <br />Charter as it pertains to traffic with a proposed development, but noted that all public records <br />become relevant. <br /> <br />Councilmember Hendriksen suggested including a statement that would say "That the City <br />Charter restrict higher density neighborhoods to direct traffic through adjacent lower density <br />neighborhoods." <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zirmnerman, to add #22 to <br />the findings of fact stating "That the City Charter restricts higher density neighborhood traffic <br />from exiting through adjoining lower density neighborhoods." <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, <br />Anderson, and Connolly. Voting No: None. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Connolly, to adopt <br />Resolution #00-0%232 adopting Findings of Fact #0531 relating to a request from Reilley <br />Estates Partnership to rezone certain property from R-1 Rural Residential to R-1 Urban <br />Residential as amended. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Connolly, <br />Anderson, and Hendriksen. Voting No: None. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Connolly, to deny the <br />request frorn Reilley Estates to rezone certain property in Section 24 from R-1 Rural Residential <br /> <br />City Council/September 13, 2000 <br /> Page 11 of 19 <br /> <br /> <br />
