City Engineer Jankowski replied technically yes, but the City could grant an easement to the property. Councilmember ZimmenTtan indicated that the lot is a lot of record and could receive a building permit. Mr. Schmaltz replied that the property is quite wet and would be difficult to build on. City Attorney Goodrich noted that when the City assesses a property they are saying that the property is being improved by the assessment. Councihnember Zimmerman stated that if the lot is buildable then the City has to assess it, but suggested if Mr. Schmaltz is not interested in building on the property then he could combine the lots at the County. Mr. Schmaltz inquired if he were to combine the two lots would it impact this assessment. Mayor Gamec replied no. Denise Schara, 15711 Juniper Ridge Drive NW, Ramsey, stated that the new coating has caused the run-off water to go down their driveway, which will be a problem in the winter. City Engineer Jankowski replied that the City will build up a bituminous berm before the snow falls. Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to close the public hearing. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmerman, Anderson, and Connolly. Voting No: None. The public hearing closed at 8:34 p.m. Council Business Mayor Gamec called the regular City Council meeting back to order at 8:34 p.m. Motion by Councilmember Zimmerman, seconded by Councilmembei' Hendriksen, to adopt Resolution #00-09-248 through #00-09-252 adopting assessments for Improvement Projects #00- 01 through//00-05.
