Councilmember Zimmennan inquired if in the final language from the DNR they require the <br />City to install the ditch block and then a ditch cleaning. <br /> <br />City Engineer Olson replied that the ditch cleaning is not a requirement of DNR, but something <br />that staff felt is necessary. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Hendriksen, to a_pprove <br />Resolution #00-12-343 approving the plans and specifications and authorizing the advertisement <br />for bids for Improvement Project #00-26, County Ditch No. 43 Cleaning. <br /> <br />Further discussion: Councilmember Hendriksen inquired if staff is confident that the ditch block <br />is such a type that it will cause the water level to stay at a certain level and if it goes over it will <br />flow fi'eely. City Engineer Olson explained that there is an emergency overflow at a certain <br />level, and anything higher will flow over. It will not cause any back-ups to residential <br />neighborhoods. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Hendriksen, <br />Anderson, and Connolly. Voting No: None. <br /> <br />Mayor Gamec recessed the regular City Council meeting at 8:53 p.m. <br /> <br />Mayor Gamec call the regular City Council meeting back to order at 9:00 p.m. <br /> <br />Case #5: Adopt Ordinance to Convey Remnant of Laud for Title Clearance Purposes <br /> <br />City Attorney Goodrich stated that this proposed ordinance was introduced at the City Council <br />meeting on November 28, 2000. The purpose for the ordinance is to allow the City to convey a <br />small parcel of land that is necessary to clear title to part of Azurite Street. The existing legal <br />description for that part of Azurite Street NW lying between Ferrum Second Addition and the <br />ACE Solid Waste, Inc. site contains errors in that it creates gaps and overlaps. In order to <br />resolve these issues, the respective landowners have agreed to exchange quit claim deeds. The <br />City will receive deeds for certain remnant parcels and the City will need to give two deeds. <br />There will be no consideration from any party. <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Connolly, to adopt <br />Ordinance #00-14 authorizing the conveyance of a part of Outlot A, FERRUM SECOND <br />ADDITION, Anoka County, Minnesota. <br /> <br />City Council/December 19, 2000 <br /> Page 15 of 19 <br /> <br /> <br />
