If negotiations with the businesses are not successful, the City of <br />Ramsey will not be held liable for the contract amount and the land will be acquired through the <br />condemnation proceedings. To accomplish this with the low bidder, it is likely that a <br />supplementary agreement be signed by both parties. The Iow bid contractor, Erickson <br />Construction, Inc. would like to commence utility construction and grading for the project <br />beginning this fall. As part of the specifications, there is a completion date for the utilities of <br />December 15, 2000. This was written into the specifications so as to allow the utility trenches an <br />opportunity to settle over the winter before construction of the street occurs. <br /> <br />Councilmember Zimmerman stated that typically the City obtains the land before a contract goes <br />out and inquired who decided to let out the bids. <br /> <br />City Engineer Olson replied that the Council gave the approval. <br /> <br />Councilmember Zimmerman stated that in the future the City should acquire the property before <br />letting out the bids. <br /> <br />City Engineer Olson noted that the project would not be authorized to move forward without the <br />signing of the proper documents. <br /> <br />Councihnember Zimmerman inquired as to how long the bids were good. <br /> <br />City Engineer Olson replied that most bids are good .for 45 days, but noted that it is possible to <br />request an extension with written documentation from both parties involved. <br /> <br />City Attorney Goodrich suggested adding the following wording to the motion "..subject to the <br />City Attorney's approval that the appropriate property rights have been acquired." <br /> <br />Councilmember Anderson questioned the difference between a right-of-entry agreement versus <br />ownership of the property. <br /> <br />City Attorney Goodrich explained that a right-of-entry agreement is a preliminary agreement to <br />allow the City to enter on the property and begin the project and then negotiate with the property <br />owner for the damage. 'If negotiations cannot be met, then the City would have to go through <br />eminent domain. <br /> <br />Councilmember Hendriksen questioned the status of the Maken property condemnation. <br /> <br />City Attorney Goodrich stated that once the funds are deposited with the court in the' amount of <br />the approved appraisal the City is given possession 90 days later which would be December 1st <br />on the Maken property. <br /> <br />Councilmember Hendriksen inquired as to when the construction was anticipated to begin. <br /> <br />City Council/October 10, 2000 <br /> Page 12 of 17 <br /> <br /> <br />
