City Engineer Olson stated that if all the agreements are signed, construction could begin on <br />October 23rd. <br /> <br />City Attorney Goodrich stated that a properly drafted right-of-access agreement is a legally <br />bound agreement. <br /> <br />Councilmember Zimmerman inquired if the property owners been approached and offered a <br />reasonable amount of money and negotiated in good faith. <br /> <br />City Engineer Olson replied yes, explaining that staff began negotiations in June and reviewed <br />what some of those negotiations have included. <br /> <br />Councilmember Zimmerman inquired if there was anyone refusing the City's offer. <br /> <br />City Engineer Olson replied that most of the property owners were happy about the construction <br />of the road and all of them have been pleasant to work with. <br /> <br />Councilmember Hendriksen inquired if there was a compelling reason to move forward with the <br />project at this time. <br /> <br />City Engineer Olson replied that staff would be able to get the contract documents in the next <br />two weeks and start construction on October 23~d. <br /> <br />Councilmember Hendriksen inquired if staff could start the documentation with approval from <br />the Council. <br /> <br />City Engineer Olson replied that it is not real appropriate to have the contractor sign a document <br />that has not been approved by the Council. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Anderson, to approve the resolution <br />awarding Project #00-21, 143~d Avenue NW Street and Utility Construction to the lowest <br />responsible bidder, Erickson Corporation, Inc., contingent upon the City Attorney's approval that <br />appropriate property rights have been acquired. <br /> <br />Further discussion: Councilmember Zimmerman stated that he was not comfortable with <br />approving a bid before the City has acquired the needed property. <br /> <br />Motion was withdrawn. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Connolly, to table action. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Connolly, <br />Anderson, and Hendriksen. Voting No: None. <br /> <br />City Council/October 10, 2000 <br /> Page 13 of 17 <br /> <br /> <br />
