CASE #4: <br />completed but couldn't get final approval because of land <br />title problems. Now, they have gotten that matter supposedly <br />squared and are back before the Council. Accordingly, the <br />following documentation is submitted for your review and <br />action as enclosure (D2 -g): <br />a) Planning and Zoning minutes dated August 4, 1980. At <br />this meeting the Planning and Zoning recommended that the <br />Council approve of preliminary plat for Pondvale Estates. <br />b) City Engineer's report dated October 28, 1980, regarding <br />preliminary plat approval. <br />c) Exhibit "A" preliminary plat plans for Pondvale Estates. <br />Council Action: Your action will be to approve /disapprove/ <br />amend Pondvale Estates preliminary plat as presented in <br />Exhibit "A ". <br />FINDING OF FACT REGARDING THE BUILDABILITY OF CERTAIN LOTS CON- <br />TAINED IN THE FOLLOWING CONSTRUCTION PROJECTS WHICH ARE REQUEST- <br />ING THAT SPECIAL ASSESSMENTS BE DELETED ON THESE PARCEL (LOTS): <br />Council at its meeting of October 14 and 15, 1980, directed the <br />City Staff to prepare finding of fact on each of the following <br />cases regarding the buildability of a lot and the deleting of <br />special assessments on the lots. <br />a) Arnie Billmark's Plat 89201 Parcel 3750 (Construction <br />Project #80 -6) - Enclosure (D2 -h) contains the finding of fact <br />that was prepared on this case. It also contains a proposed <br />resolution if you delete this assessment. <br />Comments: The unit assessment that would have to be absorbed <br />by the City if this is deleted from the assessment rolls is <br />$1,830.00. You wouldn't want to reconduct another public hear- <br />ing to assess this amount. <br />Council Action: Your action will be to review the finding of <br />fact and then to determine whether to delete the special assess- <br />ment or leave it on the rolls. Consequently, Council should <br />take the following action: <br />Motion to approve of the finding of fact in the positive/ <br />negative. <br />Council resolution will be needed if you delete this special <br />assessment. <br />b) Mr. Ronald Kramer Plat 89206 Parcel 3685 (Construction <br />Project #80 -6) - Enclosure (D2 -i) contains the finding of <br />fact that was prepared on this case. It also contains a pro- <br />posed resolution if you delete this assessment. <br />
