CASE #4: completed but couldn't get final approval because of land title problems. Now, they have gotten that matter supposedly squared and are back before the Council. Accordingly, the following documentation is submitted for your review and action as enclosure (D2 -g): a) Planning and Zoning minutes dated August 4, 1980. At this meeting the Planning and Zoning recommended that the Council approve of preliminary plat for Pondvale Estates. b) City Engineer's report dated October 28, 1980, regarding preliminary plat approval. c) Exhibit "A" preliminary plat plans for Pondvale Estates. Council Action: Your action will be to approve /disapprove/ amend Pondvale Estates preliminary plat as presented in Exhibit "A ". FINDING OF FACT REGARDING THE BUILDABILITY OF CERTAIN LOTS CON- TAINED IN THE FOLLOWING CONSTRUCTION PROJECTS WHICH ARE REQUEST- ING THAT SPECIAL ASSESSMENTS BE DELETED ON THESE PARCEL (LOTS): Council at its meeting of October 14 and 15, 1980, directed the City Staff to prepare finding of fact on each of the following cases regarding the buildability of a lot and the deleting of special assessments on the lots. a) Arnie Billmark's Plat 89201 Parcel 3750 (Construction Project #80 -6) - Enclosure (D2 -h) contains the finding of fact that was prepared on this case. It also contains a proposed resolution if you delete this assessment. Comments: The unit assessment that would have to be absorbed by the City if this is deleted from the assessment rolls is $1,830.00. You wouldn't want to reconduct another public hear- ing to assess this amount. Council Action: Your action will be to review the finding of fact and then to determine whether to delete the special assess- ment or leave it on the rolls. Consequently, Council should take the following action: Motion to approve of the finding of fact in the positive/ negative. Council resolution will be needed if you delete this special assessment. b) Mr. Ronald Kramer Plat 89206 Parcel 3685 (Construction Project #80 -6) - Enclosure (D2 -i) contains the finding of fact that was prepared on this case. It also contains a pro- posed resolution if you delete this assessment.
