The <br />approval would be contingent on review by the City Attorney. <br /> <br />Councilmember Olson stated it is a good idea to remove the county road designation <br />when the road is no longer classified as a county road. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Olson, to recommend to <br />City Council that the street signs be changed as petitioned by the residents and that 911 <br />officials be notified of the change contingent on review by the City Attorney. <br /> <br />Motion carried. Voting Yes: Chairperson Elvig, Councilmembers Cook and Olson. <br />Voting No: None. <br /> <br />Case #4: Consider the Acquisition of Property for Park and Trail Purposes <br /> <br />Assistant Public Works Director Olson reviewed that the City desires obtaining a one- <br />acre parcel, which lies between TH 47 and County Ditch 3 north of 160th Lane and <br />Elmcrest Park for the purpose of constructing a pedestrian trail access to the park from <br />the south. Staff has been directed to attempt to acquire this property through negotiations <br />with Mr. Lyrm Mortenson, the property owner. He reviewed the following summary of <br />the efforts undertaken by the City towards this acquisition: <br /> <br />· November 2004 the City hired Watson Appraisal and Consultant Service to <br /> prepare an appraisal of the property. The appraisal was received on December 3, <br /> 2004. The county assessed value of this property is $6,500. <br />· On February 14, 2005 staff presented the landowner with an offer in the appraised <br /> amount of $1,000 and advised of the right to obtain an independent appraisal at <br /> City expense. <br />· On March 10, 2005 the property owner made a counter offer of 2005 in the <br /> amount of $31,500. <br />· On April 12, 2005 the City Council rejected the owner's counteroffer and <br /> authorized the use of eminent domain, but directed staff to continue negotiations <br /> with the property owner. <br /> <br />Assistant Public Works Director Olson indicated staff has received a verbal agreement <br />with Mr. Mortenson to acquire this property for $I 1,000 which is within the guidelines <br />provided to staff for the acquisition of this property.
