ADOPT ORDINANCE AMENDING SECTION 9.11.02 <br />(ACCESSORY STRUCTURES) OF THE <br /> ZONING CHAPTER OF CITY CODE <br /> By: Breanne Dairies, Associate Planner <br /> <br />CASE # <br /> <br />5 <br /> <br />Background: <br /> <br />At the Planning Commission meeting in October 2005, the commissioners expressed a <br />desire to review and possibly alter the accessory structure size limitations in order to <br />reduce the number of Conditional Use Permits granted for size overages each year. <br />Betwveen 2003 and 2005, the City issued 161 building permits for garages. During that <br />time, the Planning Commission and City Council heard and approved 17 requests for <br />conditional use permits to exceed maximum squar~ footages on accessory structures. <br /> <br />Enclosed are the following documents: <br /> <br />a) Accessory Structure Permits and Conditional Use Permit Information <br />b) Proposed Changes to Accessory Structure Limits <br />c) Proposed Ordinance to amend 9.11.02 of City Code <br /> <br />Observations: <br /> <br />Of the 17 requests for conditional use permit to exceed maximum square footage on <br />accessory structures, 15 have been for lots between the sizes of .5 acres and 2.5 acres. <br />The suggested revisions focus on these lot-size categories. <br /> <br />The major revisions consist of two major changes: <br /> <br />1) <br /> <br />Adjust size categories. The proposed ordinance divides the smaller categories <br />differently. Under the changes, anything smaller than ½ acre would be <br />allowed accessory space equal to 10% of lot size, or 1,500 square feet, <br />whichever is less. The current category of 14,880 to 43,559 acres is too large <br />in staff's opinion, and the proposed categories would be ½ to 1 acre and 1 to <br />1.5 acres (see enclosures) <br /> <br />2) <br /> <br />Increase allowable square footages. The major changes are proposed for the <br />three categories of lot sizes in which most of the conditional use permits were <br />requested. The largest increase is 536 square feet for lots 1.5 to 2 acres in size. <br />These changes were based on the overages requested in previous Conditional <br />Use Permits. An effort was made to find a reasonable increase that would <br />reduce the requests for conditional use permits in the future. All categories <br />were rounded offto the nearest hundred for ease in application. <br /> <br />-177- <br /> <br /> <br />
