HF100 NINTH ENGROSSMENT REVISOR BD 110100-9 <br />37.1 (d) The office by rule may permit relocation of a licensed cannabis business, adopt <br />37.2 requirements for the submission of a license relocation application, establish standards for <br />37.3 the approval of a relocation application, and charge a fee not to exceed $250 for reviewing <br />37.4 and processing relocation applications. Relocation of a licensed premises pursuant to this <br />37.5 paragraph does not extend or otherwise modify the license term of the license subject to <br />37.6 relocation. <br />37.7 Sec. 13. [342.13] LOCAL CONTROL. <br />37.8 (a) A local unit of government may not prohibit the possession, transportation, or use <br />37.9 of cannabis flower, cannabis products, lower -potency hemp edibles, or hemp -derived <br />37.10 consumer products authorized under this chapter. <br />37.11 (b) Except as provided in section 342.22, a local unit of government may not prohibit <br />37.12 the establishment or operation of a cannabis business or hemp business licensed under this <br />37.13 chapter <br />37.14 (c) A local unit of government may adopt reasonable restrictions on the time, place, and <br />37.15 manner of the operation of a cannabis business or hemp business provided that such <br />37.16 restrictions do not prohibit the establishment or operation of cannabis businesses or hemp <br />37.17 businesses. A local unit of government may prohibit the operation of a cannabis business <br />37.18 within 1,000 feet of a school, day care, the Capitol or Capitol grounds, or a public park that <br />37.19 includes a playground, athletic field, or other attraction regularly used by minors. <br />37.20 (d) The office shall work with local units of government to: <br />37.21 (1) develop model ordinances for reasonable restrictions on the time, place, and manner <br />37.22 of the operation of a cannabis business or hemp business; <br />37.23 (2) develop standardized forms and procedures for the issuance of a retail registration <br />37.24 pursuant to section 342.22; and <br />37.25 (3) develop model policies and procedures for the performance of compliance checks <br />37.26 required under section 342.22. <br />37.27 (e) If a local unit of government is conducting studies or has authorized a studv to be <br />37.28 conducted or has held or has scheduled a hearing for the purpose of considering adoption <br />37.29 or amendment of reasonable restrictions on the time, place, and manner of the operation of <br />37.3o a cannabis business, the governing body of the local unit of government may adopt an <br />37.31 interim ordinance applicable to all or part of its jurisdiction for the purpose of protecting <br />37.32 the planning process and the health, safety, and welfare of its citizens.
