HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />38.1 may regulate, restrict, or prohibit the operation of a cannabis business within the jurisdiction <br />38.2 or a portion thereof until January 1, 2025. <br />38.3 (f) Within 30 days of receiving a copy of an application from the office, a local unit of <br />38.4 government shall certify on a form provided by the office whether a proposed cannabis <br />38.5 business or hemp business complies with local zoning ordinances and, if applicable, whether <br />38.6 the proposed business complies with the state fire code and building code. <br />38.7 (g) Upon receipt of an application for a license issued under this chapter, the office shall <br />38.8 contact the local unit of government in which the business would be located and provide <br />38.9 the local unit of government with 30 days in which to provide input on the application. The <br />38.10 local unit of government may provide the office with any additional information it believes <br />38.11 is relevant to the office's decision on whether to issue a license, including but not limited <br />38.12 to identifying concerns about the proposed location of a cannabis business or hemp business, <br />38.13 or sharing public information about an applicant. <br />38.14 (h) The office by rule shall establish an expedited complaint process to receive, review, <br />38.15 and respond to complaints made by a local unit of government about a cannabis business <br />38.16 or he business. Complaints may include alleged violations of local ordinances or other <br />38.17 alleged violations. At a minimum, the expedited complaint process shall require the office <br />38.18 to provide an initial response to the complaint within seven days and perform any necessary <br />38.19 inspections within 30 days. Nothing in this paragraphs prohibits a local unit of government <br />38.20 from enforcing a local ordinance. If a local unit of government notifies the office that a <br />38.21 cannabis business or hemp business other than a cannabis retailer, cannabis microbusiness <br />38.22 with a retail operations endorsement, cannabis mezzobusiness, lower -potency hemp edible <br />38.23 retailer, or medical cannabis retailer poses an immediate threat to the health or safety of the <br />38.24 public, the office must respond within 24 hours and may take any action described in section <br />38.25 342.19 or 342.21. <br />38.26 (i) Notwithstanding the foregoing provisions, the state shall not issue a license to any <br />38.27 cannabis business to operate in the Indian Country, as defined in United States Code, title <br />38.28 25, section 1151, of a Minnesota Tribal government without the consent of the Tribal <br />38.29 government. <br />38.30 Sec. 14. [342.14] CANNABIS LICENSE APPLICATION AND RENEWAL. <br />38.31 Subdivision 1. Application; contents. (a) The office by rule shall establish forms and <br />38.32 procedures for the processing of cannabis licenses issued under this chapter.
