HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />85.1 Sec. 37. [342.37] CANNABIS TESTING FACILITY LICENSING. <br />85.2 Subdivision 1. Authorized actions. A cannabis testing facility license entitles the license <br />85.3 holder to obtain and test immature cannabis plants and seedlings, cannabis flower, cannabis <br />85.4 products, hemp plant parts, hemp concentrate, artificially derived cannabinoids, <br />85.5 lower -potency hemp edibles, and hemp -derived consumer products from cannabis <br />85.6 microbusinesses, cannabis mezzobusinesses, cannabis cultivators, cannabis manufacturers, <br />85.7 cannabis wholesalers, lower -potency hemp edible manufacturers, medical cannabis <br />85.8 cultivators, medical cannabis processors, and industrial hemp growers. <br />85.9 Subd. 2. Additional information required. In addition to the information required to <br />85.10 be submitted under section 342.14, subdivision 1, and rules adopted pursuant to that section, <br />85.11 a person, cooperative, or business seeking a cannabis testing facility license must submit <br />85.12 the following information in a form aaaroved by the office: <br />85.13 (1) an operating plan demonstrating the proposed layout of the facility, including a <br />85.14 diagram of ventilation and filtration systems and policies to avoid sales to unlicensed <br />85.15 businesses; <br />85.16 (2) proof of accreditation by a laboratory accrediting organization approved by the office <br />85.17 that, at a minimum, requires a laboratory to operate formal management systems under the <br />85.18 International Organization for Standardization; and <br />85.19 (3) evidence that the business will comply with the applicable operation reauirements <br />85.20 for the license being sought. <br />85.21 Subd. 3. Multiple licenses; limits. (a) A person, cooperative, or business holding a <br />85.22 cannabis testing facility license may not own or operate, or be employed by, any other <br />85.23 cannabis business or hemp business. <br />85.24 (b) The office by rule may limit the number of cannabis testing facility licenses a person <br />85.25 or business may hold. <br />85.26 (c) For purposes of this subdivision, a restriction on the number of licenses a business <br />85.27 may hold applies to every cooperative member or every director, manager, and general <br />85.28 partner of a cannabis business. <br />85.29 Sec. 38. [342.38] CANNABIS TESTING FACILITY OPERATIONS. <br />85.30 Subdivision 1. Testing services. A cannabis testing facility shall provide some or all <br />85.31 testing services required under section 342.61 and rules adopted pursuant to that section. <br />Article 1 Sec. 38. 85 <br />
