HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />105.1 Sec. 51. [342.51] MEDICAL CANNABIS RETAILERS. <br />105.2 Subdivision 1. Authorized actions. (a) A medical cannabis retailer license entitles the <br />105.3 license holder to purchase medical cannabis flower and medical cannabinoid products from <br />105.4 medical cannabis cultivators and medical cannabis processors and sell or distribute medical <br />105.5 cannabis flower and medical cannabinoid products to any person authorized to receive <br />105.6 medical cannabis flower or medical cannabinoid products. <br />105.E (b) A medical cannabis retailer license holder must verifv that all medical cannabis <br />105.8 flower and medical cannabinoid products have passed safety, potency, and consistency <br />105.9 testing at a cannabis testing facility approved by the office for the testing of medical cannabis <br />105.10 flower and medical cannabinoid products before the medical cannabis retailer may distribute <br />105.11 the medical cannabis flower or medical cannabinoid product to any person authorized to <br />105.12 receive medical cannabis flower or medical cannabinoid products. <br />105.13 Subd. 2. Distribution requirements. (a) Prior to distribution of medical cannabis flower <br />105.14 or medical cannabinoid products, a medical cannabis retailer licensee must: <br />105.15 (1) review and confirm the patient's registry verification; <br />105.16 (2) verifv that the Derson reauestina the distribution of medical cannabis flower or <br />105.17 medical cannabinoid products is the patient, the patient's registered designated caregiver, <br />105.18 or the patient's parent, legal guardian, or spouse using the procedures specified in section <br />105.19 152.11. subdivision 2d: <br />105.20 (3) ensure that a pharmacist employee of the medical cannabis retailer has consulted <br />105.21 with the patient if required according to subdivision 3; and <br />105.22 (4) apply a patient -specific label on the medical cannabis flower or medical cannabinoid <br />105.23 product that includes recommended dosage requirements and other information as required <br />105.24 by rules adopted by the office. <br />105.25 (b) A medical cannabis retailer may not deliver medical cannabis flower or medical <br />105.26 cannabinoid products unless the medical cannabis retailer also holds a cannabis delivery <br />105.27 service license. Delivery of medical cannabis flower and medical cannabinoid products are <br />105.28 subject to the provisions of section 342.42. <br />105.29 Subd. 3. Final approval for distribution of medical cannabis flower and medical <br />105.30 cannabinoid Droducts. (a) A cannabis worker who is emDloved by a medical cannabis <br />105.31 retailer and who is licensed as a pharmacist pursuant to chapter 151 shall be the only person <br />105.32 who may give final approval for the distribution of medical cannabis flower and medical <br />105.33 cannabinoid products.
