HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />106.1 cannabinoid products, a pharmacist employed by the medical cannabis retailer must consult <br />106.2 with the patient to determine the proper type of medical cannabis flower, medical cannabinoid <br />106.3 product, or medical cannabis paraphernalia and proper dosage for the patient after reviewing <br />106.4 the range of chemical compositions of medical cannabis flower or medical cannabinoid <br />106.5 product. For purposes of this subdivision, a consultation may be conducted remotely by <br />106.6 secure videoconference, telephone, or other remote means, as long as: <br />106.E (1) the pharmacist engaging in the consultation is able to confirm the identity of the <br />106.8 patient; and <br />106.9 (2) the consultation adheres to patient privacy requirements that apply to health care <br />106.10 services delivered through telemedicine. <br />106.11 (b) Notwithstanding paragraph (a), a pharmacist consultation is not required prior to the <br />106.12 distribution of medical cannabis flower or medical cannabinoid products when a medical <br />106.13 cannabis retailer is distributing medical cannabis flower or medical cannabinoid products <br />106.14 to a patient according to a patient -specific dosage plan established with that medical cannabis <br />106.15 retailer and is not modifying the dosage or product being distributed under that plan. Medical <br />106.16 cannabis flower or medical cannabinoid products distributed under this paragraph must be <br />106.17 distributed by a pharmacy technician employed by the medical cannabis retailer. <br />106.18 Subd. 4. 90-day supply. A medical cannabis retailer shall not distribute more than a <br />106.19 90-day supply of medical cannabis flower or medical cannabinoid products to a patient, <br />106.2o registered designated caregiver, or parent, legal guardian, or spouse of a patient according <br />106.21 to the dosages established for the individual patient. <br />106.22 Subd. 5. Distribution to recipient in a motor vehicle. A medical cannabis retailer may <br />106.23 distribute medical cannabis flower and medical cannabinoid products to a patient, registered <br />106.24 designated caregiver, or parent, legal guardian, or spouse of a patient who is at a dispensary <br />106.25 location but remains in a motor vehicle, provided that: <br />106.26 (1) staff receive payment and distribute medical cannabis flower and medical cannabinoid <br />106.27 products in a designated zone that is as close as feasible to the front door of the facility. <br />106.28 (2) the medical cannabis retailer ensures that the receipt of payment and distribution of <br />106.29 medical cannabis flower and medical cannabinoid products are visually recorded by a <br />106.30 closed-circuit television surveillance camera and provides any other necessary security <br />106.31 safeguards; <br />106.32 (3) the medical cannabis retailer does not store medical cannabis flower or medical <br />106.33 cannabinoid broducts outside a restricted access area and staff transbort medical cannabis <br />Article 1 Sec. 51. 106 <br />
