HF100 NINTH ENGROSSMENT REVISOR BD 1-10100-9 <br />109.1 (b) A patient's enrollment in the registry program must only be denied if the patient: <br />109.2 (1) does not submit a certification from a health care practitioner or, if the patient is a <br />109.3 veteran, the documentation required under subdivision 3 that the patient has been diagnosed <br />109.4 with a qualifying medical condition; <br />109.5 (2) has not signed the disclosure required in subdivision 2; <br />109.6 (3) does not provide the information required by the Division of Medical Cannabis; <br />109.7 (4) provided false information on the application; or <br />109.8 (5) at the time of application, is also enrolled in a federally approved clinical trial for <br />109.9 the treatment of a qualifying medical condition with medical cannabis. <br />109.10 (c) If the Division of Medical Cannabis denies a patient's enrollment in the registry <br />109. i i program, the Division of Medical Cannabis must provide written notice to a patient of all <br />109.12 reasons for denying enrollment. Denial of enrollment in the registry program is considered <br />109.13 a final decision of the office and is subject to judicial review under chapter 14. <br />109.14 (d) A patient's enrollment in the registry program may be revoked only: <br />109.15 (1) pursuant to subdivision 2, paragraph (c); <br />109.16 (2) upon the death of the patient; <br />109.17 (3) if the patient's certifying health care practitioner has filed a declaration under <br />i o9. i s subdivision 2, paragraph (c), that the patient's qualifying diagnosis no longer exists and the <br />i o9. i 9 patient does not submit another certification within 30 days, <br />109.20 (4) if the patient does not comply with subdivision 6; or <br />109.21 (5) if the patient intentionally sells or diverts medical cannabis flower or medical <br />109.22 cannabinoid broducts in violation of this chapter. <br />109.23 If a patient's enrollment in the registry program has been revoked due to a violation of <br />109.24 subdivision 6, the patient may apply for enrollment 12 months after the date on which the <br />109.25 patient's enrollment was revoked. The office must process such an application in accordance <br />109.26 with this subdivision. <br />109.27 Subd. 5. Registry verification. When a patient is enrolled in the registry program, the <br />109.28 Division of Medical Cannabis must assign the patient a patient registry number and must <br />109.29 issue the patient and the patient's registered designated caregiver, parent, legal guardian, or <br />109.30 spouse, if applicable, a registry verification. The Division of Medical Cannabis must also <br />Article 1 Sec. 52. 109 <br />
