Commissioner Johnson asked if it is a code issue, or if they could develop criteria that would <br />justify a variance. <br /> <br />Community Development Director Trudgeon indicated they could, but he is a little concerned <br />that with the parking requirements and other factors that they may not ever be able to meet the <br />current requirements. He stated they want to encourage the verticalness, and thinks the applicant <br />is doing a good job, but does not know if they can ever meet the requirements in the core area. <br /> <br />Community Development Director Trudgeon stated that they may not need a variance on this site <br />at this time, but know that as more buildings are built on this site they will have the issue. He <br />would rather address it in the ordinance than through a variance. <br /> <br />Commissioner Brauer stated you almost could meet the square footage if you took out the open <br />space pieces that are in here. He indicated that the way he calculated it he got close to the high <br />80%. He wondered if they could justify granting a variance because of the open space they are <br />provided. <br /> <br />Community Development Director Trudgeon suggested there were many ways to look at it, but <br />he would suggest moving forward with this one and looking at the code. <br /> <br />Commissioner Johnson asked about the access issues. <br /> <br />Community Development Director Tmdgeon stated there are two options. The original thought <br />was needed a road further to the north that would provide access from Rhinestone to Sapphire. <br />He indicated the other option is to allow that to occur as needed through the northern area of the <br />parking lot. He stated he cannot speak for the developer on his preference. <br /> <br />Dennis Sharp, Sharp and Associates, indicated that the owner is relatively acceptable to the idea <br />of having a heavier profile of a street going through the parking, more or less. He stated that <br />would possibly take care of the questions on access from Sapphire to Rhinestone. He indicated <br />he would question if they have to put asphalt through all the way right now. He stated the other <br />question would be if on a temporary basis they could put asphalt curb. <br /> <br />Community Development Director Trudgeon indicated they could look at that since the curb <br />would not be in existence when the rest of the parking went in. <br /> <br />Commissioner Johnson stated that he thinks this looks like a decent development, and he would <br />rather decide how the top portion can develop when that comes in, and not require this <br />development to do something extraordinary to facilitate what might be. <br /> <br />Commissioner Johnson asked Kevin Miller, URS if Ramsey Town Center, LLC will be <br />developing the area to the north. <br /> <br />Mr. Miller indicated that Mr. Voss of Ramsey Town Center, LLC has three different developers <br />looking at this to develop three different lots in Outlot A.
