been changed to be up to three days, but only two times annually with a maximum of six days <br />per year. She noted a change in Court time policy for "D" shift officers to receive a minimum of <br />three hours pay if they are required to appear in court before 1:00 p.m. the same day. She stated <br />that the "D" shift begins about 6:00 p.m. and ends at 2:00 a.m. <br />Councilmember Dehen asked how often the City's officers appeared in court. <br />Assistant City Administrator Nelson stated that she was unsure because it varies. <br />Councilmember Dehen asked if there was a way to communicate with our attorney to ensure that <br />our officers are not just sitting around. He stated that, in his experience, the officers spend more <br />time sitting around doing nothing rather than testifying because 99% of the cases end up settling. <br />City Administrator Ulrich stated that this will be communicated with our prosecutor. <br />Assistant City Administrator Nelson reviewed the other general terms of the labor agreement. <br />Mayor Gamec asked how close the City was coming to having uniform policies for City <br />employees and police officers. <br />Assistant City Administrator Nelson stated that they are not uniform because there are separate <br />issues with each department and it varies between union and non -union employees. <br />Motion by Mayor Gamec, seconded by Councilmember Olson, to recommend that the City <br />Council approve the recommended changes to the City's labor agreement with LELS-Patrol with <br />the proposed language to be effective January 2008 — December 2009. <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Olson and Dehen. Voting <br />No: None. Absent: Chairperson Jeffrey. <br />Case #2: Consider a Resolution Approving the 2008-2009 Labor Agreement with <br />LELS-Sergeants <br />Assistant City Administrator Nelson stated that this contract is very similar to the LELS-Patrol <br />contract just discussed. She reviewed the proposed changes stated and that the Standby time <br />provision was supposed to be included in the Patrol contract as well and appears to have been <br />left out. <br />Mayor Gamec asked if the Standby provision was new. <br />Assistant City Administrator Nelson stated that it has always been part of the contract, but this <br />new language identifies a 24-hour period. <br />Councilmember Dehen asked if the City's prosecutor was aware of the contract language <br />pertaining to standby time and cancellation policies. <br />Personnel Committee / February 26, 2008 <br />Page 2 of 6 <br />
