Further Discussion: Councilmember Jeffrey requested that outside of this case that Human <br />Resources Manager Reed Kone brings information from the League of Minnesota Cities, <br />regarding what information is appropriate regarding personnel situations. He stated that he <br />would like the Personnel Committee to discuss this before there is a full Council discussion. <br />Motion carried. Voting Yes: Chairperson Dehen and Councilmembers Jeffrey and McGlone. <br />Voting No: None. <br />Case #2: Consider a Resolution Appointing Members to the Board of Administrative <br />Hearings <br />Human Resources Manager Reed Kone reviewed the staff report. She noted that the minutes <br />may have been off because there was discussion about Bill McGowen or Jim Bendtson serving <br />on this committee with Jason Tossey. She noted that the City Attorney has also determined that <br />it may not be permissible for Councilmember Dehen to serve on this board because of due <br />process issues. <br />Chair Dehen stated that perhaps the way to solve this to have two Councilmembers serve on this <br />Board of Administrative Hearings with one lay person, and then it would go to the Council with <br />those two people not being voting members or even sitting members on the Council when there <br />is an appeal. <br />Human Resources Manager Reed Kone stated that Mayor Ramsey suggested Joe Field who <br />serves on the Charter Commission, who is also an attorney, to serve on this Board. She <br />explained the confusion about whether the Council intended for Bill McGowen or Jim Bendtson <br />to serve on this Board with Jason Tossey. <br />Councilmember Jeffrey stated that he remembers Jason Tossey and Bill McGowen with Jim <br />Bendtson serving as an alternate. He stated that he feels there needs to be someone with legal <br />expertise to convene this Board. <br />Chair Dehen stated that he had the same recollection. He asked if Councilmember McGlone or <br />Councilmember Jeffrey were interested in serving on this Board so there would be two <br />Councilmembers. <br />Councilmember McGlone stated that he doesn't feel qualified to run that type of meeting and <br />agreed that there should be some legal minded aspect to this. He suggested that perhaps Joe <br />Field be on a $25 stipend to lead these meetings and all Councilmembers stay out of it. <br />Councilmember Jeffrey stated that Joe Field didn't interview for any positions and if he is <br />appointed, then that circumvents the process the Council created for Boards and Commissions. <br />Chair Dehen stated that he feels there are plenty of lawyers out there that may agree to do this for <br />$50 or $100. <br />Personnel Committee /April 14, 2009 <br />Page 3 of 5 <br />
